R-86-07 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON ORDERING <br />THE ANNEXATION OF TERRITORY TO THE COLTON LANDSCAPE AND <br />LIGHTING MAINTENANCE ASSESSMENT DISTRICT NO.2 AND <br />LEVYING ASSESSMENTS FOR FISCAL YEAR 2007/2008 <br />WHEREAS, on June 19, 2007, the City Council (the "City Council") of the City <br />of Colton adopted Resolution No. R-76-07, declaring its intention to annex certain territory to <br />the Colton Landscape and Lighting Maintenance Assessment District No. 2 (the "Assessment <br />District") and scheduling a public hearing thereon; and <br />WHEREAS, by Resolution No. R-77-07, the City Council approved the report <br />of MuniFinancial, the engineering firm employed by the City for the annexation proceedings <br />(the "Report") which contained, among other matters, the proposed assessments to be levied <br />for fiscal year 2007-08 upon assessable lots and parcels of property which comprise the <br />Assessment District; and <br />WHEREAS, pursuant to Section 53753 of the Government Code, by <br />Resolution No. R-78-07, the City Council directed the City Clerk to mail notice of the <br />proposed annexation and the proposed assessments and of the time and place of the public <br />hearing thereon to the record owner of each parcel of property identified in the Report and <br />further directed that each such mailed notice contain an assessment ballot upon which the <br />property owner could indicate his or her support or opposition to the proposed assessments; <br />and <br />WHEREAS, the City Council has conducted the public hearing with respect to <br />the annexation of the territory proposed to be annexed to the Assessment District and has <br />received a report from the City Clerk regarding the tabulation of the assessment ballots <br />submitted, and not withdrawn, in support of or opposition to the proposed assessments <br />advising that the ballots which were received were voted in favor of the proposed <br />
