1 <br />RESOLUTION NO R-121-08 <br />2 <br />3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />ADOPTING A MASTER FEE SCHEDULE FOR PROGRAMS & SERVICES <br />4 PROVIDED BY THE COMMUNITY SERVICES DEPARTMENT OF THE CITY <br />OF COLTON <br />5 WHEREAS, under the police power granted by Article XI, Section 7 of the California <br />6 <br />Constitution, cities may impose fees, charges and rates for certain municipal services; and <br />7 <br />WHEREAS, in addition to the authority granted by the State Constitution, Government <br />8 <br />Code section 66016 provides that a city may establish or increase fees for certain public <br />9 <br />services by resolution; and <br />10 <br />11 WHEREAS, the City Council of the City of Colton has determined that in order to <br />12 continue providing effective service for the public welfare, the City must establish and increase <br />13 fees for certain municipal services which accurately reflect the City's true costs in providing such <br />14 services; and <br />15 WHEREAS, many of the City's existing fees for community and park facilities and <br />16 services no longer reflect the City's true costs in providing and maintaining the services and <br />17 facilities to which the fees pertain, as a result of increased costs borne by the City; and <br />18 WHEREAS, the City Council has determined that the fees proposed in this Resolution <br />19 are reasonable, fair and equitable in nature and are proportionately representative of the costs <br />20 incurred by the City for the described services; and <br />21 WHEREAS, in addition, the City Council has determined that it is reasonable and fair for <br />22 the City to subsidize programs and facilities for residents and charge a non -subsidized fee to <br />23 non-residents because the subsidy is paid from municipal funds which residents contribute to <br />24 through local property taxes and sales taxes and because the purposes of the community and <br />25 <br />park facilities and services are to promote the health and welfare of residents; and <br />26 <br />WHEREAS, the City Council has determined that the proposed non -subsidized fees for <br />27 <br />non-residents are justified because: (1) the fees do not discriminate on the basis of race, color, <br />28 <br />religion or national origin; (2) the fees are not higher than the City's cost to provide and maintain <br />the services and facilities; and (3) the fees are not disproportionately higher than the fees <br />
