1 <br />2 RESOLUTION NO. R-74-08 <br />3 A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF COLTON APPROVING THE <br />4 QUIMBY DEDICATION REQUIREMENT AND <br />IN-LIEU FEE STUDY (QUIMBY STUDY) AND <br />5 ESTABLISHING UPDATED LAND <br />DEDICATION REQUIREMENTS AND <br />6 REVISED IN-LIEU FEES <br />7 <br />WHEREAS, Article 11, Section 7 of the California Constitution authorizes <br />8 <br />the City of Colton ("City") to enact measures that protect the health, safety and <br />9 <br />welfare of its citizens; and <br />10 <br />WHEREAS, the Quimby Act, Government Code Section 66477, authorizes <br />11 <br />a City to require the dedication of land or impose a requirement of the payment <br />12 <br />of fees in lieu thereof, or a combination of both, for park or recreational purposes <br />13 <br />as a condition to the approval of a tentative map or parcel map; and <br />14 <br />WHEREAS, according to the City's General Plan, the goal for acquisition <br />15 <br />and development of parks for the City is 5.0 acres for every 1,000 residents; and <br />16 <br />WHEREAS, the City has adopted a Master Plan entitled City of Colton <br />17 <br />Comprehensive Park and Facilities Master Plan, dated 2004, containing policies <br />18 <br />and standards for parks and facilities and the park and recreational facilities are <br />19 <br />in accordance with definite principles and standards; and <br />20 <br />WHEREAS, park development impact fees collected by the City are <br />21 <br />insufficient alone to meet the goal of acquisition and development of parks; and <br />22 <br />WHEREAS, it is fair and equitable for new development to pay its fair <br />23 <br />share and contribute to financing, acquisition and initial development of new <br />24 <br />parks and the rehabilitation of existing neighborhood or community parks and <br />25 <br />recreational facilities; and <br />26 <br />WHEREAS, a process for deferral or reduction of fees will allow for better <br />27 <br />or fairer financing arrangements and ensure fees are fairly imposed according to <br />28 <br />impact created and benefit received; and <br />ORANGE\MMARTINEZ\49200.2 _ 1 _ <br />
