R-89-13 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />DESIGNATING CITY STAFF AUTHORIZED FOR EXAMINATION OF <br />SALES, USE AND TRANSACTIONS TAX RECORDS <br />WHEREAS, pursuant to California Revenue and Taxation Code Section 7200, et seq., the <br />City of Colton adopted Ordinance 1484 on October 7, 1975 which imposes a sales and use tax to <br />be administered and collected by the State Board of Equalization ("Board") along the same <br />existing statutory and administrative procedures followed by the State Board of Equalization in <br />administering and collecting the California State Sales and Use Taxes; and <br />WHEREAS, on August 7"', 2001, Resolution R-71-01 authorized an agreement for sales <br />tax audit and information services with the firm of Hinderliter de Llamas and Associates <br />("HDL"), designating HDL as the City's authorized consultant to examine such sales tax records <br />maintained by the Board on behalf of the City of Colton; and <br />WHEREAS, the City Council of the City of Colton deems it desirable and necessary for <br />authorized representatives of the City to examine confidential sales, use and transactions tax <br />records of the Board pertaining to sales, use and transactions taxes collected by the Board; and <br />WHEREAS, Section 7056 of the California Revenue and Taxation Code sets forth certain <br />requirements and conditions for the disclosure of Board records, and establishes criminal <br />penalties for the unlawful disclosure of information contained in, or derived from, the sales, use <br />and transactions records of the Board. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES <br />HEREBY RESOLVE AND FIND AS FOLLOWS: <br />Section 1. Recitals. The Recitals set forth above are true and correct and <br />incorporated into this Resolution by reference. <br />Section 2. CEQA. The adoption of this Resolution does not commit the City of <br />Colton to any action that may have a significant effect on the environment. As a result, such <br />action does not constitute a project subject to the requirements of the California Environmental <br />
