R-34-11 <br />RESOLUTION OF THE CITY OF COLTON AUTHORIZING AND <br />APPROVING SUBMITTAL OF A REQUEST FOR EXPANSION OF <br />THE GEOGRAPHIC BOUNDARIES OF THE SAN BERNARDINO <br />VALLEY ENTERPRISE ZONE BY THE CITY OF COLTON, CITY <br />OF SAN BERNARDINO, COUNTY OF SAN BERNARDINO AND <br />INLAND VALLEY DEVELOPMENT AGENCY <br />WHEREAS, the City of Colton adopted Resolution R-108-06 on April 15, 2006, <br />authorizing the preparation and submittal of a formal application to the State of California, <br />Department of Housing and Community Development, for the designation of the "San <br />Bernardino Valley Enterprise Zone" ("SBVEZ"), in participation with the City of San <br />Bernardino, County of San Bernardino and Inland Valley Development Agency ("IVDA"); <br />and <br />WHEREAS, the SBVEZ was awarded a final designation by the State of California <br />Department of Housing and Community Development on March 5, 2009, retroactive to <br />October 15, 2006; and <br />WHEREAS, the City of Colton, the City of San Bernardino, County of San <br />Bernardino and IVDA entered into that certain Memorandum of Understanding, dated <br />November 19, 2008 ("MOU"), regarding governance and participation in the SBVEZ; and <br />WHEREAS, the City of Colton, City of San Bernardino, County of San Bernardino <br />and IVDA now seek to expand the geographic boundaries of the SBVEZ, as allowed by <br />California law; and <br />WHEREAS, the City of Colton, City of San Bernardino, County of San Bernardino <br />and IVDA must all approve expansion of the SBVEZ, pursuant to the MOU, as part of <br />submitting an expansion request to the State of California. <br />NOW, THEREFORE THE CITY OF COLTON DOES HEREBY RESOLVE <br />AND FIND AS FOLLOWS: <br />Section 1. Recitals. The recitals preceding this Resolution are true and correct <br />and are incorporated into this Resolution. <br />Section 2. CEQA. The City Council certified a Program Environmental Impact <br />Report (PEIR) for the San Bernardino Valley Enterprise Zone (SCH # 2007101304) <br />("PEIR") on January 10, 2008. Pursuant to Section 21166 of the Public Resources Code, no <br />subsequent environmental impact report shall be required unless project changes will require <br />major revisions to the existing environmental impact report, changes in circumstances <br />require major revisions to the existing environmental impact report, or new information <br />becomes available, which was not known and could not have been known at the time the <br />- 1 - <br />
