2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0-10-02 <br />AN ORDINANCE OF THE CITY OF COLTON ADDING CHAPTER 12.40 TO TITLE <br />12 OF THE COLTON MUNICIPAL CODE REGARDING PROPER REMOVAL AND <br />DISPOSAL OF CANINE FECES <br />WHEREAS, the City of Colton ("City") is authorized pursuant to Article 7, Section 11 of the <br />California Constitution to "make and enforce within its limits all local, police, sanitary, and other <br />ordinances and regulations not in conflict with general laws " including the regulation of animals; and <br />WHEREAS, the City Council of the City of Colton hereby finds and declares all of the following: <br />(a) The City has seen an increase of canine feces left on public and private property. <br />(b) Uncollected canine feces negatively impacts the visual and aesthetic character of public <br />and private property. <br />(c) Uncollected canine feces is a serious and widespread threat to the health and welfare <br />of citizens of the City. Canine feces contains a variety of organisms, such as bacteria and internal <br />parasites, which may be both communicable and harmful to humans, especially children. <br />(d) Various diseases and parasitic infestations also can be spread from dog to dog through <br />uncollected canine feces. <br />(e) Canine feces also poses environmental if uncollected waste contaminates streams or <br />other sources of water. <br />(f) Therefore, the City Council of the City of Colton finds that regulations governing the <br />proper removal and disposal of canine feces are necessary to promote the City's aesthetics and public <br />health and welfare of its citizens. <br />THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS FOLLOWS: <br />SECTION 1: Chapter 12.40 of Title 12 of the Colton Municipal Code is hereby added to <br />read as follows: <br />"Chapter 12.40 <br />DISPOSAL OF CANINE FECES ON PUBLIC AND PRIVATE PROPERTY <br />I Sections: <br />12.40.10 <br />Duty to dispose. <br />12.40.20 <br />Method of Disposal. <br />12.40.30 <br />Enforcement. <br />12.40.40 <br />Exemption. <br />12.40.10 Duty to Dispose. <br />RVPUB\AYC\634912 -1- <br />
