R-112-88 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON DECLARING THAT THE ACQUISITION FOR <br />PUBLIC USE OF CERTAIN PROPERTY BY EMINENT <br />DOMAIN IS NECESSARY. <br />WHEREAS, pursuant to Code of Civil Procedure Section <br />1245.235, the City Council of the City of Colton scheduled a <br />Public hearing for November 1, 1988, at 7:30 p.m. at the City <br />Hall of the City of Colton, 650 North La Cadena Drive, Colton, <br />California, and gave to each person who owns property to be <br />acquired a reasonable opportunity to appear at said hearing and <br />be heard on the matters referred to in Code of Civil Procedure <br />Section 1240.030; and, <br />WHEREAS, said hearing has been held by the City Council <br />and each person who owns property to be acquired by eminent <br />domain was afforded an opportunity to be heard on said matters; <br />and <br />WHEREAS, the City Council may now adopt a Resolution of <br />Necessity pursuant to Code of Civil Procedure Section 1245.230; <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON <br />DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: <br />Section 1. That there has been compliance with the <br />requirements of Code of Civil Procedure Section 1245.235 <br />regarding notice and hearing. <br />Section 2. That the public use for which said fee <br />simple interests, easements and rights-of-way are to be taken is <br />to provide electrical energy, and that Government Code Section <br />37350.5 authorizes the City of Colton to acquire real or personal <br />property of every kind within or without the City by eminent <br />
