1 ORDINANCE NO. 0-07-23 <br /> 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> 3 COLTON, CALIFORNIA, AMENDING COLTON MUNICIPAL <br /> CODE SECTIONS 2.12.010, 2.12.020, 2.12.030, AND 2.12.050 <br /> 4 INCREASING CITY CLERK AND CITY TREASURER SALARY <br /> AND CITY COUNCIL AND MAYOR SALARY AND AUTOMOBILE <br /> 5 ALLOWANCE <br /> 6 WHEREAS, the City of Colton, California ("City") is a general law city organized and <br /> 7 existing under the Constitution and laws of the State of California. <br /> WHEREAS, California Government Code section 36516 provides a method by which <br /> 8 salaries for members of the City Council are established and increased. <br /> WHEREAS, California Government Code Section 36516(a) authorizes the City <br /> 9 Council to enact an ordinance providing that each member of the City Council shall receive a <br /> 10 salary based on the population of the City. <br /> WHEREAS, California Government Code Section 36516(a)(4) further authorizes the <br /> 11 City Council to increase City Council salaries beyond the amount based on the population of <br /> 12 the City, so long as such increase does not exceed an amount equal to five percent (5%) for <br /> each calendar year from the operative date of the last adjustment of salary. <br /> 13 WHEREAS, Colton Municipal Code Sections 2.12.030 and 2.12.050 establish the <br /> salary for city councilmembers and the mayor, respectively. <br /> 14 WHEREAS, the city councilmember and mayor salary, adopted in 2011 pursuant to <br /> 15 Ordinance No. No. 0-01-11 is currently set at $400 per month, plus $220 per month in auto <br /> allowance. <br /> 16 WHEREAS, the City Council has not elected to increase or adjust the salary for the <br /> City Council in twelve years. <br /> 17 WHEREAS, Government Code section 36517 allows the City Council to fix City Clerk <br /> 18 and City Treasurer salaries by ordinance or resolution. <br /> WHEREAS, Colton Municipal Code Sections 2.12.010 and 2.12.020 establish the <br /> 19 salary for the city clerk and city treasurer, respectively. <br /> WHEREAS, in line with recent City employee salary increases, the City Council <br /> 20 desires to also increase the salaries for the City Clerk, City Treasurer, City Council, and <br /> 21 Mayor by amending Colton Municipal Code sections 2.12.010, 2.12.020, 2.12.030, and <br /> 2.12.050. <br /> 22 WHEREAS, the City Council desires to similarly increase the automobile allowance <br /> for City Council and the Mayor. <br /> 23 WHEREAS, the proposed salary increases are in compliance with the Government <br /> 24 Code. <br /> WHEREAS, all other legal prerequisites to the adoption of this Ordinance have <br /> 25 occurred. <br /> NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON, <br /> 26 CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: <br /> 27 SECTION 1. Incorporation of Recitals. The Recitals herein are true and correct and <br /> an incorporated herein by this reference. <br /> 28 SECTION 2. Amendment to Municipal Code.
