ITEM #10 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR THE MEETING OF MARCH 20, 2007 <br />TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS <br />FROM: AMER JAKHER, P.E., CITY ENGINEER <br />SUBJECT: AUTHORIZE STAFF TO USE CALTRANS 12.7% FIVE-YEAR <br />ROLLING AVERAGE OF THE CALTRANS HIGHWAY <br />CONSTRUCTION ITEMS INDEX IN THE UPDATE OF THE 2006 <br />DEVELOPMENT MITIGATION STUDY AS REQUIRED BY SAN <br />BERNARDINO ASSOCIATED GOVERNMENTS. <br />DATE: MARCH 8, 2007 <br />BACKGROUND: <br />On October 5, 2005, the San Bernardino Association of Governments (SANBAG), acting as the <br />San Bernardino County Congestion Management Agency, approved a Development Mitigation <br />Nexus Study (Appendix K of the SANBAG Congestion Management Program) ("SANBAG Nexus <br />Study"). The SANBAG Nexus Study contains information and data that form the basis for <br />identifying fair share contributions from new development in Colton to pay for regional <br />transportation improvements (freeway interchanges, railroad grade separations, and regional arterial <br />highways.). These regional transportation improvements are needed to mitigate the traffic impacts <br />of new development. <br />Pursuant to the California Mitigation Fee Act (AB 1600), local agencies are granted the authority to <br />impose development impact fees to mitigate the impacts of new development. Under the <br />Mitigation Fee Act the local agency's must: (1) identify the purpose of the fee; (2) identify the use <br />to which the fee is to be put; (3) determine how there is a reasonable relationship between the fee's <br />use and the type of development project; and (4) determine how there is a reasonable relationship <br />between the need for the public facility - in this case regional traffic improvements - and the type of <br />development project. (See California Govt. Code § 66001(a).) <br />Accordingly, the SANBAG Nexus Study contains these findings, identifies specific improvements <br />proposed to the regional transportation network and includes an estimate of costs for these projects, <br />including the City of Colton's fair share of these improvements. The SANBAG Nexus Study also <br />includes an estimate of growth in dwelling units and employment expected over the planning period <br />of the SANBAG Nexus Study (2004 to 2030). These estimates have been prepared by each of the <br />local jurisdictions in conjunction with SANBAG and SCAG. <br />
