1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 ITEM #4 ORDINANCE NO. 0-03-07 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON AMENDING SECTION 18.20.120 OF THE COLTON MUNICIPAL CODE TO INCLUDE PARKING REQUIREMENTS FOR GYMNASIUMS AND FOR RACQUETBALL/ TENNIS COURTS WHEREAS, the City Council of the City of Colton (the "City Council") held a duly noticed public hearing on , 2007, after giving published notice, of the proposed amendment to Section 18.20.120(A) of the Colton Municipal Code to include parking requirements for gymnasiums and for racquetball/tennis courts located within the B -P (Business Park) Zone (the "Zone Text Amendment"); and WHEREAS, on March 27, 2007, the Planning Commission of the City of Colton ("Planning Commission") also conducted a duly noticed public hearing on the Zone Text Amendment at which time all persons wishing to testify in connection with the Zone Text Amendment were heard and the Zone Text Amendment was comprehensively reviewed and recommended for approval; and WHEREAS, the Planning Commission adopted a Resolution recommending approval of the Zone Text Amendment to the City Council; and WHEREAS, the City Council has determined that the Zone Text Amendment is consistent with the City of Colton General Plan ("General Plan") as indicated below; and WHEREAS, the City Council has determined that the proposed Zone Text Amendment is in the best interests of the City, and that it would be in the public interest to approve the Zone Text Amendment; WHEREAS, the Application was reviewed, studied, and found exempt from the California Environmental Quality Act ("CEQA") as more fully described below; and WHEREAS, all other legal prerequisites to the adoption of this Ordinance have occurred. THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS FOLLOWS: SECTION 1.
