DELGADO't� <br />Interim City Clerk <br />SUBJECT: CERTIFICATION OF PETITION TO RECALL <br />MAYOR GEORGE V. FULP AND RESOLUTIONS CALLING <br />FOR SPECIAL MUNICIPAL ELECTION, REQUESTING <br />CONSOLIDATION OF ELECTION AND REQUESTING COUNTY <br />SERVICES <br />DATE: JULY 30, 1996 <br />Background: <br />Proponent Sal A. Rios II filed a Petition to Recall Mavor George V. <br />Fulp on July 3, 1996. <br />Discussion <br />After prima facie examination of the Petition by this office, it <br />was determined that the number of signatures on said Petition was <br />in excess of the 3,526 signatures required and the Petition was <br />deemed filed. <br />Recognizing that verification of approximately 6,275 signatures <br />within 30 days would require the majority of staff time, the <br />Petition was submitted to the Registrar of Voters Office for <br />verification of signatures. This decision was also based on the <br />limited number of staff and on the fact that, currently, the City <br />Clerk's Office is conducting the nomination period for five City <br />offices for the November election. <br />On July 24, 1996, the Registrar of Voters Office submitted their <br />Certificate to Petition which declared that the Petition had <br />passed. As directed by Elections Code Section 11227, I am <br />submitting the Certificate of Sufficiency of said Petition. <br />Following certification, Elections Code Section 11240 directs that <br />within 14 days the governing body shall issue an order calling the <br />election. If the governing body does not act within the prescribed <br />time, Elections Code Section 11241 directs that within 5 days, the <br />County Elections Official shall set the date for holding the <br />election. <br />ITEM NO. 20 <br />
