On January 28, 1997, the Planning Commission <br />considered File Index Number DO -36-96, a proposed ordinance to repeal the existing adult <br />use regulatory scheme set forth in Chapter 18.48 in its entirety and replace it with revised <br />adult use regulations as set forth in a new Chapter 18.49 to the Colton Municipal Code. <br />After consideration of all the evidence presented, including public testimony, staff and <br />consultant comments, and exhibits, including: the City's zoning map, a zoning map showing <br />1,000 foot radius from residential zones, maps showing available M-2 zoned properties, <br />photographs of available sites, published cases and studies conducted by other cities <br />documenting negative secondary side effects of adult entertainment businesses, as well as <br />the initial Study and draft Negative Declaration, the Commission adopted the attached <br />Resolution, Number R-01-97, a recommendation to the City Council to adopt a Negative <br />Declaration for the proposed adult use ordinance project and to adopt the proposed <br />ordinance regulating adult uses and repealing and replacing certain sections of the Colton <br />Municipal Code regulating adult uses. <br />DISCUSSION/ANALYSIS: <br />The new Chapter 18.49 defines, establishes and regulates the circumstances and locations <br />in which adult uses may be sited and operated within the community. The proposed new <br />ordinance establishes definitions; locational limitations; development and operating <br />standards related to: hours of operation, lighting requirements, access provisions, minors' <br />access, regulation of closed booths, regulation of viewing areas, business License, on-site <br />manager and security measures, and other operating requirements relating to the location of <br />performances and tipping; permit requirements, violations, applicability to other regulations, <br />and conduct constituting a public nuisance. The proposed ordinance also repeals sections <br />18.48.010, 18.04.018 and 18.22.040(A) of the Colton Municipal Code and amends section <br />18.06.060, a matrix of uses by zone. <br />Item No. 24 <br />
