Kivley, Assistant to th City Manager <br />Subject: Amend Chapter 15.40 of the Municipal Code, Historic Preservation, <br />Sections 15.40.030, Definitions and 15.40.080 Nomination and <br />designation program for historic resources <br />Date: February 1, 1999 <br />BACKGROUND <br />In February 1998, the City of Colton applied to the State of California, Office of Historic Preservation for <br />certification as a Certified Local Government (CLG) in California. This CLG status is necessary in order <br />for the City to apply for grant funds from the State of California, Department of Parks and Recreation <br />when available. Once certified, the City is then eligible to apply for funds from the federal Historic <br />Preservation Fund. In prior years Congress established a pass-through grant program whereby at least <br />ten percent (10%) of California's annual federal grant for statewide historic preservation was distributed <br />on a competitive basis to CLGs for local preservation programs. In June 1998, the City received notice <br />from the State there are three unresolved issues prior to approving our request for CLG status. Two of <br />the issues involve modifications in two areas of the Municipal Code,delegation of responsibilities and <br />districts. The third issue relates to assurances the Historic Preservation Commission is composed of the <br />most qualified individuals from within our community. <br />DISCUSSION /ANALYSIS <br />From staff's perspective, the recommended changes to the Municipal Code to comply with the State <br />requirements are simple. The following information details the requested modifications. <br />Section 15.40.030 Definitions. <br />The Section currently specifies the "Preservation Officer is the Director of Community Development <br />Department who will serve as staff to the Historic Preservation Commission and coordinate Colton's <br />historic preservation programs. The director may, from time to time, delegate duties as authorized by <br />the City Manager". The recommended change will delineate the City Manager as the Preservation Officer <br />and allow the City Manager to appoint a staff liaison to the commission. This request change will <br />provide a separation of delegation of responsibilities of historic preservation functions from community <br />development duties. This places the responsibility with different individuals to avoid any possibility of <br />conflict of interest between functions and interests of Community Development and Historic Preservation. <br />Section 15.40.080 Nomination and designation program for historic resources. <br />By definition and function, the Section provides for the inclusion of districts by referring to historic, scenic <br />and urban conservation districts in the City of Colton. The Section.then contains language that proljibits <br />the placement of districts on the list of nominated resources. The Section specifies the Preservation <br />Commission shall undertake to establish and maintain a list of nominated resources that have been ' <br />identified in a survey, but "districts may not be placed on the list". As the code reads now, this Section <br />contains contradictory language. Staff suggests the verbiage "district may not be placed on the list'.. be <br />removed from the Section thereby satisfying the State's request and removing any contradictory <br />language. <br />Item # 2 <br />
