HUTTON, PUBLIC WORKS DIRECTOR <br />SUBJECT: DECLARATION OF INTENTION TO VACATE STREET RIGHT-OF-WAY OF A <br />PORTION OF HIGHLAND AVENUE WESTERLY OF 8T" STREET, BETWEEN <br />PLEASANT VIEW AVENUE AND CITRUS AVENUE AND APPROVE RESOLUTION <br />OFINTENT <br />DATE: DECEMBER 16, 1998 <br />BACKGROUND: <br />The Jon Lin Company has requested the vacation of the street right-of-way of a portion of <br />Highland Avenue Westerly of 8"' Street, between Pleasant View Avenue and Citrus. See <br />attached Exhibit "A" for legal description and map. <br />This portion of right-of-way is no longer needed for road purposes, but the City will retain <br />underground utility easement rights for operation of 8" ACP water main and 2 fire hydrant <br />assemblies. <br />The item was reviewed by Design Review at their meeting of November 16, 1998, and was <br />recommended for vacation, subject to compliance with conditions as set forth in the Conditions <br />of Approval and the Reservation by the City of all utility easements. See Attachment "B". <br />RECOMMENDATION: <br />It is recommended that the Council APPROVE Resolution of Intent and accept the vacation request <br />subject to the conditions of approval and declare "Intention to Vacate", and that a public hearing on this <br />vacation be set at the January 19, 1999 City Council Meeting. <br />JRK/pc/bjw <br />Attachments: Exhibits "A" and "B" <br />Resolution of Intent <br />Item # 4 <br />Page 1 of 1 <br />
