HUTTON, PUBLIC WORKS DIRECTOR <br />SUBJECT: RESOLUTION INITIATING PROCEEDINGS FOR THE 1999-2000 FISCAL YEAR <br />ASSESSMENT LEVY OF THE CITY WIDE LANDSCAPE MAINTENANCE DISTRICT <br />AND DECLARING INTENTION OF A PUBLIC HEARING REGARDING THE <br />L.L.M.D. FOR TUESDAY, AUGUST 3,1999. <br />DATE: JUNE 23,1999 <br />BACKGROUND: <br />The City Council previously formed a Landscape and Lighting Maintenance Assessment <br />district. This formation was accomplished pursuant to the provisions for landscaping and <br />Lighting Act of 1972, Part 2 of Division 15 of the Streets and Highways Code of California. <br />This Act provides for the levy and collection of assessments by the County of San Bernardino <br />for the City of Colton to pay the maintenance and services of lighting, landscaping, and all <br />appurtenant facilities and operations related to the L.L.M.D. No. 1. <br />The L.L.M.D. consists of 8 Zones of which five (5) Zones have an annual levy. The benefit <br />Zones are Cooley Ranch (Zone 1), La Loma Hills (Zone 3), Old Colton (Zone 4), Reche <br />Canyon (Zone 5) and West Valley (Zone 8). The improvements within the District include: turf, <br />ground cover, street trees, irrigation systems, perimeter landscaping, slopes, open space, <br />lighting systems and all necessary appurtenances. The costs associated with the <br />improvements are equitably spread between all benefiting parcels within the Zones. Only <br />parcels that receive direct benefit from the improvements are assessed. <br />DISCUSSIONiANALYSIS: <br />Prior to a Public Hearing the Act requires that certain resolutions be adopted. The required <br />resolutions are Initiating Proceedings for the Annual Levy of Assessments, Declaring Intention <br />to Levy the Annual Assessment and Preliminary Approval of the Annual Levy Report, prepared <br />by M.B.I.A. (formerly Muni Financial Inc.) the Landscape Maintenance District Engineers. <br />The Preliminary Report has been prepared by M.B.I.A. for the various L.L.M.D. Zones <br />indicating the L.L.M.D. expenses have not increased and there are no additions to the District, <br />therefore the report reflects the same budget and assessment as 1998/99 and there are no <br />recommended increases for 1999/2000. <br />Section 7 of the resolution Declaring Intention to Levy Annual Assessments gives notices that <br />a Public Hearing regarding the LLMD will be held on Tuesday, August 3, 1999. At this time the <br />City Council will hear testimony regarding the Preliminary Report of revenue and expenditures <br />contemplated for the 1999/2000 L.L.M.D. <br />item # 19 <br />
