Parrish, Assistant City Manager <br />Amendment to the Joint Use Agreement Between the City of Colton <br />and the Colton Joint Unified School District for the Joint Use of <br />Facilities at the East Lower Field at McKinley Elementary School <br />DATE: March 13, 2000 <br />BACKGROUND: <br />In August 1985 the City of Colton and the Colton Joint Unified School District approved <br />an agreement for the joint use of the East Lower Field at McKinley Elementary School <br />(the "lower field"). The primary user of the lower field is the Colton Tee Ball League, a <br />youth sports league in the community. Recently, there has been some confusion <br />regarding maintenance and other responsibilities at the lower field that are not <br />adequately addressed in the existing Joint Use Agreement. On November 22, 1999 <br />City staff met at the lower field with School District staff to discuss these issues in <br />person. As a result of that meeting District staff agreed to prepare a draft of the salient <br />points discussed at that meeting for review and discussion. That draft was delivered to <br />City staff on January 6, 2000. <br />DISCUSSIONIANALYSIS: <br />The existing Joint Use Agreement is segmented into twelve (12) individual paragraphs. <br />The following are those paragraphs where staff is recommending that amendments be <br />made. For those paragraphs not specifically mentioned we are recommending that they <br />remain the same. <br />Paragraph #3: Currently, the agreement states that "the District's representative and <br />the City's representative shall meet as necessary to transact business in accordance <br />with this agreement." We are suggesting the following amendment. <br />Specify by office as to who the District's Representative(s) and the City's <br />Representative(s) will be. For the District, the representative will be the District <br />Facilities Office and for the City, the representative will be the City Manager's Office. <br />Paragraph #8: Currently, the agreement <br />structures shall be the responsibility of the <br />are suggesting the following amendment. <br />states that "maintenance of equipment / <br />owner of the equipment or structure."
