Placentia Lane) - Bobby W. Stark <br />and Kathie L. Stark - Proposed Maintenance and Abatement <br />Agreement <br />TE: June 4, 2002 <br />BACKGROUND: <br />Bobby W. Stark and Kathie L. Stark are the owners of real property located at 2081 <br />Placentia Lane (3779 W. Placentia Lane) ("Subject Property"). The owners operate an un- <br />licensed towing business on the Subject Property. The owners were given notice of certain <br />nuisance conditions on the Subject Property and ordered to abate the same on September <br />06, 2001, October 15, 2001, and October 18, 2001. These conditions include the <br />following: miscellaneous debris throughout the Subject Property, lack of screening, <br />inoperative vehicles and vehicle parts, dry overgrown vegetation, and conducting business <br />without a license or a conditional use permit. <br />On December 5, 2001, after the required notice, a public hearing concerning the <br />Subject Property was held before the Code Enforcement Housing Appeals Board ("Appeals <br />Board") and on December 17, 2001, the Appeals Board adopted the findings and <br />conditions described in Resolution No. R-27-01. The Appeals Board held that the owners <br />must abate the nuisance on the Subject Property within 30 days of December 17, 2001. <br />On January 15, 2002, the owners filed a timely appeal of the Appeals Board's decision <br />adopting Resolution R-27-01. The owners agreed to stay their appeal while negotiating a <br />Maintenance and Abatement Agreement with the City. <br />DISCUSSION: <br />On February 12, 2002, the owners and their attorney met with City Code <br />Enforcement staff and the City Attorney to discuss the potential terms of the Maintenance <br />and Abatement Agreement. The owners executed the Maintenance and Abatement <br />Agreement on May 28, 2002. <br />RVPUMNGS\633365 -1 - <br />
