Item #1 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF JUNE 1, 2004 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: DARYL PARRISH, CITY MANAGER <br />SUBJECT: RESOLUTION ESTABLISHING CERTAIN NEW FEES AND <br />INCREASING CERTAIN EXISTING FEES FOR VARIOUS SERVICES <br />PROVIDED BY THE CITY <br />DATE: MAY 19, 2004 <br />BACKGROUND: <br />In recent months the City has established new and increased fees for various City <br />services and programs in an effort to offset the City's costs for providing such services. <br />City staff has continued to analyze costs incurred by the City for various services to <br />determine if additional fees are appropriate and justified. <br />The City has the authority to impose fees, charges and rates under the police power <br />granted by Article XI, Section 7 of the California Constitution and under the provisions <br />of Government Code section 66016. In addition to providing authority to impose fees, <br />State law also requires that fees imposed by the City may not exceed the estimated <br />reasonable cost of providing the service for which a fee is charged. Along with this <br />restriction on fee amounts, Section 66016 of the Government Code requires the City to <br />hold a public hearing prior to adopting fees and make available to the public the data <br />indicating the amount of estimated costs required to provide the service for which a fee <br />is being charged. <br />DISCUSSION/ANALYSIS: <br />City staff has reviewed and analyzed costs incurred by the City in connection with <br />services provided by the City's Geographic Information System ("GIS") database, the <br />City's Questys database, and the duplication of audio and video tapes. Regarding fees <br />for producing electronic information, the City currently does not charge for services <br />related to production of electronic documents from databases. However, Government <br />Code section 6253.9 allows public agencies to recover their costs for producing records <br />stored electronically. Specifically, Section 6253.9 provides that a person requesting <br />records stored electronically "shall bear the cost of producing a copy of the record, <br />including the cost to construct a record, and the cost of programming and computer <br />services necessary to produce a copy of the record..." As a result of this analysis, City <br />staff has determined that it is appropriate for the City to establish new fees for costs <br />1 <br />
