Zamora, Community Development Director <br />SUBJECT: Approve a Second Amendment to the Professional Services Agreement <br />for Environmental Consulting Services with Duane Morita in the Amount <br />of $50,000. <br />DATE: September 22, 2005 <br />BACKGROUND: <br />On October 4, 2005, the City Council approved a $15,000 Amendment to the Professional <br />Services Agreement for Duane Morita, an Environmental Consultant to the Community <br />Development Department. Mr. Morita's services were initially approved on August 17, 2004, in <br />the amount of $25,000 through a Letter of Agreement for Professional Services executed by the <br />City Manager. Mr. Morita prepares Environmental Assessments/Initial Studies for Development <br />Application Proposals for the Department. His Scope of Services requires him to report to the <br />Community Development Department one day per week to prepare environmental <br />assessments/initial studies for the more complex development projects proposed in the City. <br />Compensation for the Services is based on the actual amount of time spent in preparing the initial <br />studies at an hourly rate of seventy-eight dollars ($78.00). <br />The Consultant has exhausted the contract amount therefore staff is requesting approval of a <br />Second Amendment to the Professional Services Agreement in the amount of $50,000 to <br />continue the preparation of environmental assessments/initial studies for current and future <br />Development Applications received by the Department. <br />ANALYSIS/DISCUSSION: <br />The Amendment will allow the Consultant to continue providing professional environmental <br />services to the Community Development Department for new Development Applications requiring <br />the preparation of an environmental assessment/initial study. The Environmental <br />Assessment/Initial Study is required by State law under the California Environmental Quality Act <br />(CEQA). The preparation of an Environmental Assessment/Initial Study is very time consuming <br />and requires the Consultant to review and analyze reports, studies, files, data, and prior <br />environmental documents in order to adequately prepare the environmental assessment of new <br />development projects. Once completed, the Environmental Assessment/Initial Study is circulated <br />to the public and Responsible Agencies for comments. If the public or any outside agency <br />submits comments to the Department, the Consultant must provide a response to the comments. <br />The contracted service the Consultant provides allows Planning Staff the opportunity to respond <br />to general customer service demands at the counter and by telephone in addition to other projects <br />that are time sensitive. <br />Approval of this Professional Services Agreement is exempt pursuant to CMC Section 3.08.140 <br />
