472 <br />Litigation <br />Mrs. Ann McNabb addressed the Council and inquired as to how <br />Superior Court Case 222853 affects her. Ms. McNabb stated she had <br />been in contact with Best, Best, & Krieger attempting to obtain infor- <br />mation and was informed that if she responded through an attorney, it <br />could result in a suit being filed against her. <br />City Attorney Edwards responded that Ms. McNabb is referring to the <br />tax increment problem on the Cooley Ranch. Mr. Edwards stated Council <br />will recall there was allegation with regard to erroneously crediting <br />the different types of tax increment payments. Mr. Edwards stated the <br />possiblity arose that the City did not properly account for these tax <br />increment fund payments. Mr. Edwards stated the Agency contracted <br />Best, Best & Krieger to file suit in Superior Court to have the court <br />make the determination as to whether the allegation is true and if so, <br />what should be done about it. <br />City Attorney Edwards said it is a very complex matter and he cer- <br />tainly could not respond with regard to Ms. McNabb's particular par- <br />cel; however, he will act as an intermediary between her and Best, <br />Best & Krieger. Mr. Edwards asked that Ms. McNabb see him during <br />regular business hours with her parcel number documentation. <br />AT).Tn IiRNMFNT. <br />Moved by Councilman Rehrer, seconded by Councilwoman Cisneros and <br />unanimously passed, Mayor Huntoon adjourned the meeting at 8:02 p.m. <br />ifs - ' a 7r2 Com- <br />HELEN A.
