1 ORDINANCE NO. 1291 III <br />2;I AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF COLTON ESTABLISHING REGULATIONS <br />` FOR DEDICATION OF LAND, PAYMENT OF FEES <br />OR BOTH FOR PARK AND RECREATIONAL LAND <br />IN SUBDIVISIONS. <br />5� <br />THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS FOLLOWS: <br />6� <br />SECTION 1. RECITALS. That the City Council of the City of <br />.8,Colton, does hereby -find, determine and declare as followsm <br />;e <br />9 (a)In 1965, the Legislature of the State of California <br />10 amended the, Subdivision Map Act; and <br />11 (o) Before a city or county may avail itself of said Act, <br />12 <br />it must have a general plan containing a recreational element; and <br />13 <br />(c) The City Council of the City of Colton has adopted a <br />14 <br />15 general plan containing such recreational element. <br />16 SECTION 2. SUBDIVIDERS MUST PROVIDE PAR1< AND RECREATIONAL <br />17 FACILITIES.. Every subdivider who subdivides land shall dedicate a <br />18lportion of such land, pay a fee, or do both, as set forth in this <br />19 I�ordinance for the purpose of providing park and recreational facil- <br />20 <br />ities to serve future residents of such subdivision. <br />21 <br />22 SECTION 3. APPLICATION. The provisions of this ordinance <br />23 I shall apply to all subdivisions, as that phrase is defined in <br />24 Section 11500 et seq. of the Business and Professions Code of the <br />25 State of California, except subdivisions for which tentative sub - <br />26 division maps have been filed within thirty (30) days after the <br />27effectivedate of this ordinance and industrial subdivisions. <br />28 <br />SECTION 4. RELATION OF LAND REQUIRED TO POPULATION DENSITY. <br />29 <br />
