R-01-06 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON DENYING THE APPEAL AND UPHOLDING THE PLANNING COMMISSION'S DECISION TO DENY A REQUEST FOR PLACEMENT OF CHAIN LINK FENCING ON PROPERTY LOCATED ON PENNSYLVANIA AVENUE BETWEEN ACACIA AND LAUREL STREET — APN NO. 161-061- 36: FILE INDEX NO. DAP- 000-510 WHEREAS, an application was filed by Williams Furnace Company ("Applicant") to permit the continued placement of a chain link fence on Pennsylvania Avenue between Acacia and Laurel Street in the City of Colton ("Subject Property"); and WHEREAS, Section 18.38.010(E) and Section 18.38.050 of the Colton Municipal Code provide that the Colton Design Review Committee ("DRC") is authorized to review, approve, conditionally approve or deny applications for chain link fencing after giving consideration to appearance, structural quality and durability; and WHEREAS, the Application was referred to the Colton DRC and denied by the DRC on October 17, 2005; and WHEREAS, the Application was timely appealed to the Colton Planning Commission ("Planning Commission"); and WHEREAS, on November 22, 2005, the Planning Commission considered the appeal of the Application at which time all persons wishing to testify in connection with the proposed Application were heard, and the appeal of the Application was comprehensively reviewed; and WHEREAS, the Planning Commission denied the appeal of the Application because they believed that allowing the placement of new chain link fence on this property would erode the City's attempt to maintain and improve the visual appearance and aesthetics of the neighborhood; and R V PUB\HSHANE\70621 I.1 I
