R-01-06 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON DENYING THE APPEAL AND UPHOLDING THE PLANNING <br />COMMISSION'S DECISION TO DENY A REQUEST FOR PLACEMENT OF <br />CHAIN LINK FENCING ON PROPERTY LOCATED ON PENNSYLVANIA <br />AVENUE BETWEEN ACACIA AND LAUREL STREET — APN NO. 161-061- <br />36: FILE INDEX NO. DAP- 000-510 <br />WHEREAS, an application was filed by Williams Furnace Company <br />("Applicant") to permit the continued placement of a chain link fence on Pennsylvania <br />Avenue between Acacia and Laurel Street in the City of Colton ("Subject Property"); <br />and <br />WHEREAS, Section 18.38.010(E) and Section 18.38.050 of the Colton <br />Municipal Code provide that the Colton Design Review Committee ("DRC") is <br />authorized to review, approve, conditionally approve or deny applications for chain <br />link fencing after giving consideration to appearance, structural quality and durability; <br />and <br />WHEREAS, the Application was referred to the Colton DRC and denied by the <br />DRC on October 17, 2005; and <br />WHEREAS, the Application was timely appealed to the Colton Planning <br />Commission ("Planning Commission"); and <br />WHEREAS, on November 22, 2005, the Planning Commission considered the <br />appeal of the Application at which time all persons wishing to testify in connection <br />with the proposed Application were heard, and the appeal of the Application was <br />comprehensively reviewed; and <br />WHEREAS, the Planning Commission denied the appeal of the Application <br />because they believed that allowing the placement of new chain link fence on this <br />property would erode the City's attempt to maintain and improve the visual <br />appearance and aesthetics of the neighborhood; and <br />R V PUB\HSHANE\70621 I.1 <br />I <br />
