Hutton, Director of Public Works <br />SUBJECT: Public Hearing, Street Vacation for Date: June 26, 1990 <br />Centerpointe Dr. <br />f Lrfi: f—OTC VAam <br />On June 5, 1990 Council set a public hearing for the vacation of Centerpointe Dr. <br />as part of the Walmart Stores project. <br />STATEMENT OF THE PROBLEM: <br />First City Properties Inc., has contacted Public Works and has requested that the <br />vacation of Centerpointe Dr. be contingent upon the closing of escrow with Gatlin/ <br />Berger Development (Walmart). First City is requesting that the vacation of <br />Centerpointe Dr. be recorded through the escrow. Staff has discussed this matter <br />with the City Attorney, RDA and the City Engineer and they concur with the request. <br />ALTERNATIVES: <br />Council may postpone the public hearing and street vacation after the close of escrow <br />which is scheduled for the end of July. <br />FINANCIAL IMPACT: <br />None <br />ENVIRONN=AL IMPACT: <br />None <br />RDCOM EMAT ION : <br />Staff recommends that at the conclusion of the public hearing, if sufficient protests <br />are not heard that Council approve the vacation of Centerpoint Dr. contingent upon <br />the close of escrow between First City Properties Inc., and Gatlin/Berger Development <br />(Walmart Stores). <br />CITY MANAGER'S CONCURRENCE: <br />Attachments: 1 <br />MMINAE <br />Page I of_—__ CENTRAL RECORDS _ Item No. C <br />
