CITY OF COLTON <br />AGENDA REPORT <br />For Council Meeting of December 3, 1991 <br />TO: Honorable Mayor and City Council <br />FROM: Leslie Keane Stratton, City Manager <br />Date: 11/26/91 <br />SUBJECT: <br />Councilmanic Districts <br />BACKGROUND: <br />Colton as a general law city, absent an ordinance to the contrary, <br />elects its council members from the community at large. Government <br />Code S 34871 allows cities, with a vote of the people, to adopt an <br />ordinance establishing electoral districts and to elect council <br />members "by" or "from" these districts. Election "by" district <br />_limits those who may be candidates for city council and those who <br />may vote to specific districts, but allows all city residents to <br />vote on candidates from every district. Cities who elect their <br />mayors separately may choose to establish four, six, or eight <br />councilmanic districts. <br />Government Code S 34872 sets out specific requirements for a <br />district election ordinance. The ordinance must include the <br />following: <br />1. The number of districts proposed. <br />2. A description of the boundaries of each district. <br />3. The numbering of each district. <br />4. A statement as to whether council members will be elected <br />"by" or "from" districts. <br />As the Council is aware, the "Colton Voters for Fair Representation <br />Committee" ("Committee") submitted an initiative petition on <br />October 10, 1991 designed to place an ordinance on the ballot <br />establishing the election of council members "by" six districts. <br />The City Clerk's office verified the signatures on the petition in <br />accordance with Elections Code S 3708 and certified the petition as <br />sufficient with respect to "procedure." Since the proposed <br />ordinance, however, did not number or contain a description of <br />district boundaries, the City Attorney suggested that the ordinance <br />might be invalidated in the courts. At Council's November 5, 1991, <br />meeting you directed staff to prepare a report on the ordinance, as <br />required by Elections Code S 4009.5, and to report back within 30 <br />days. As a part of that direction, you suggested that we cooperate <br />with the "Committee" and begin the process of establishing district <br />boundaries. <br />Item No. 127 <br />CENTRA.
