CITY OF COLTON <br />AGENDA DEPORT <br />"ForMeeting of March 1, 1994 <br />COUNCIL <br />Community Develo ment Oector <br />SUBJECT: Public Hearing of File Index Number DO -04194, an amendment to DATE: February 23, 1994 <br />Chapter 18.56 of the Colton Municipal Code (Zoning Ordinance) <br />Relating to Property Maintenance <br />BACKGROUND: <br />At their regular meeting of February 8, 1994,1 the Planning Commission recommend, by <br />Resolution No. R-01-94, approval of an amendment to Title 18 of the Colton Municipal Code <br />(Zoning Ordinance). The amendment will imposi'e greater restrictions upon property than is <br />required by the existing provisions of this Chapters Additionally, this proposed amendment will <br />allow the City to exercise discretion in the abatement of Municipal Code Violations, specifically, <br />non -health and safety issues. <br />DISCUSSION/ANALYSIS: <br />Presently, staff is abating substandard buildings and hazardous or unsanitary premises in <br />compliance with the Uniform Housing Code, 1991 Edition. However, items in the existing <br />property maintenance chapter, not covered in the Housing Code, are being addressed through <br />this amendment so that those items can also be abated and brought into compliance with the <br />City's codes. The proposed amendment outlines the procedures to be taken when there is <br />failure by the property owner to voluntarily abate';a declared nuisance. <br />The proposed amendment also re-establishes the Code Enforcement and Housing Advisory <br />Appeals Board. The purpose of the Board is to he and decide appeals of orders, decisions or <br />determinations made by the Building Official relative to the application and interpretations c5f the <br />Uniform Housing Code and the Property Maintenance Chapter of the Zoning OrdinanceJ The <br />Board shall consist of members who are qualified, by experience and training, to passup on <br />matters pertaining to Building Construction. The Housing Advisory and Appeals Board sholl be <br />appointed by the City Council and shall hold office at the Council's discretion. If a declared <br />nuisance is not completely abated by the owner within the time prescribed in the Code <br />Enforcement and Housing. Advisory Appeals Board order, staff would be authorized to cause the <br />nuisance to be abated by either City crews or pr ate contract. The cost for abating such a. <br />nuisance shall constitute a special assessment agai st respective property and, upon recordation <br />with the County Recorder, shall constitute a 'lie on the property for the amount of such <br />assessment. <br />Page 1 of 2 Item No. 17 <br />
