and pump stations also, it is agreed that all the improved properties in the District at the <br />time of confirmation of assessment shall have the right to connection to the system constructed <br />under these proceedings upon payment of monies as set forth per formula for sewage treatment <br />plant capacity. This section establishes fee so charge be that sum established in Article 5 (a) <br />formula and sets up the collection by the San Bernardino County Building Department and trans- <br />mission to City of Colton prior to the last day of June and prior to the last day of December <br />of each year. <br />(e) Areas of Mutual Benefit. It has been determined that the -mutual benefit derived by the <br />existing facilities of Colton and the proposed facilities of the District are equal and as <br />such, the District shall have the right to connect to the existing facilities of Colton and <br />Colton shall have the right to connect to the proposed facilities in the areas as indicated <br />on Exhibit "C" without additional cost to either of the parties. <br />Councilman Rehrer asked how much this facility would raise the volume of the sewer plant. <br />Mr. Young replied that the total area within the District would contribute 1-1/2 million <br />gallons bringing the sewer capacity to about half of the total capability. <br />Councilman Gonzales asked if the City could go on charging extra charges to areas outside of <br />the Colton City -Limits. <br />Mr. Young replied that in one area the City charges tripple the inside rate and that perhaps <br />it would be best for -the City to look into imposing these charges at a future date. <br />Council asked Mr. Xicak for the estimated time of completion for this project. <br />Mr. Kicak replied that a 12 6. 14 -month time is anticipated. <br />City Attorney Hutton remarked that he felt that any monies owed by either party to the other <br />should be paid as outlined in the various procedures without any interest due. <br />Mr. Kicak agreed that the no interest due would be fair to all parties. <br />City Attorney Hutton suggested the following language be added to so stipulate non-interest <br />payments. <br />Page 6, third paragraph, add to last sentence as follows: Said payment shall be made by one <br />party to the other party, as the case may be, on or before six (6) months after said actual <br />cost can be computed. Such sums so payable from the due date thereof shall be non-interest <br />bearing. <br />Mr. Hutton stated that the present proposed agreement was probably the third attempt and that <br />although the agreement was proper in every Aorm, he would like Council's and Mr. Kicak's <br />permission to review the agreement one more time to smooth out the language. <br />Mr. Hutton gave examples of changes that would be made to -the language. <br />Council and Mr. Kicak indicated that the language modification was in their opinion fair and <br />advantageous to both parties. - <br />On motion of Councilwoman Spragins, seconded by Councilman Hayes and unanimously passed, <br />Resolution No. 3455 was approved. <br />RESOLUTION NO. 3455 - RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON APPROVING AGREEMENT <br />WITH COUNTY OF SAN BERNARDINO, COUNTY SERVICE AREA NO. 70, IMPROVEMENT <br />ZONE "H" FOR SEWAGE TRANSPORTATION, TREATMENT AND DISPOSAL. <br />Mr. Kicak said that on behalf of himself and the Advisory Commission, he would like to thank <br />the Council and Staff for the time and effort afforded this agreement, it has been a real <br />pleasure working with the City of Colton. <br />ADJOURNMENT <br />There being no further business to come before the Council, on motion of Councilman Rehrer, <br />seconded by Councilman Hayes, and unanimously passed, Mayor Huntoon adjourned the meeting <br />at 8:09 p. m. <br />HELEN A.
