2 <br />El <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0-09-17 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON AMENDING <br />SECTION 18.38.070 (ELECTRIC FENCES AND BARBED WIRE FENCES) OF TITLE 18 <br />OF THE COLTON MUNICIPAL CODE TO ALLOW ELECTRIC FENCES IN THE M-1 <br />(LIGHT INDUSTRIAL) AND M-2 (HEAVY INDUSTRIAL) ZONES (FILE INDEX NO. <br />DAP -001-431). <br />WHEREAS, on August 22, 2017 and September 26, 2017, the Planning Commission of <br />the City of Colton ("Planning Commission") conducted a duly noticed public hearing and <br />recommended the City Council of the City of Colton ("City Council") to amend Section 18.3 8.070 <br />(Electric Fences and Barbed Wire Fences) of Title 18 of the Colton Municipal Code (the "Municipal <br />Code") to allow electric fences in the M-1 (Light Industrial) and M-2 (Heavy Industrial) Zones. <br />Following the conclusion of said hearing, the Planning Commission adopted their Resolution No. <br />R-25-17, recommending approval to the City Council "Zoning Text Amendment"; and <br />WHEREAS, the City Council has determined that the Zoning Text Amendment is <br />consistent with the City of Colton General Plan ("General Plan") as indicated below; and <br />WHEREAS, the City Council has determined that the proposed Zoning Text Amendment <br />is in the best interests of the City, and that it would be in the public interest to approve the Zone <br />Text Amendment; and <br />WHEREAS, the Zoning Text Amendment was reviewed, studied and found exempt from <br />the California Environmental Quality Act ("CEQA") as more fully described below; and <br />WHEREAS, on November 07, 2017, the City Council held a duly noticed public hearing <br />at which persons wishing to testify in connection with the Zoning Text Amendment were heard and <br />the Zoning Text Amendment was comprehensively reviewed. <br />WHEREAS, all other legal prerequisites to the adoption of this Ordinance have occurred. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES <br />ORDAIN AS FOLLOWS: <br />SECTION 1. The City Council hereby adopts the recitals and findings set forth above and <br />in the agenda report prepared in connection with this Ordinance. <br />SECTION 2. General Plan Consistency. Based on the entire record before the City Council <br />and all written and oral evidence presented, including the staff report and the findings made in this <br />Ordinance, the City Council hereby finds and determines that the proposed Ordinance is consistent <br />with the goals and policies of the City of Colton General Plan and is reasonably related to the public <br />welfare of the citizens of the City and surrounding regions. Specifically, the provisions of this <br />Ordinance make clear that new electric fences shall only be permitted in the M-1 and M-2 industrial <br />zones and are required to be installed to meet all building and safety requirements. Permitting this <br />flexibility within the M-1 and M-2 industrial zones within the City of Colton furthers the City's <br />goals and policies as set forth in the City of Colton General Plan, specifically: <br />Land Use Element. Permitting electric fences within M-1 (Light Industrial) and M-2 <br />(Heavy Industrial) zones is consistent with the Industrial Districts policies of the City of Colton <br />Land Use Element, specifically: <br />o Policy LU -11.3: "Increase and diversify local employment opportunities, and retain <br />and accommodate industrial development that is compatible with City objectives for <br />
