CITY OF COLTON <br />AGENDA REPORT <br />FOR SPECIAL COUNCIL MEETING OF MARCH 15, 2007 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: DARYL PARRISH, CITY MANAGE <br />SUBJECT: CITY'S FORMAL COMPLAINT PROCESS AND PROCEDURES <br />PERTAINING TO EMPLOYEE GRIEVANCES, APPEALS, HEARINGS, <br />INVESTIGATIONS, NOTIFICATIONS, SEXUAL HARASSMENT, AND <br />HOSTILE WORK ENVIRONMENT. <br />DATE: <br />BACKGROUND: <br />March 15, 2007 <br />Members of the City Council have asked for an overview of the City's personnel polices and <br />procedures on several employment related subjects. Those policies and procedures are <br />contained in a variety of ordinances, administrative polices, memoranda of understanding, and <br />other documents, each of which are discussed below. <br />Resolution No. R-15-00 — Personnel System Rules and Regulations for the City of Colton <br />This Resolution, adopted March 7, 2000, covers a wide variety of personnel and employment <br />related topics. Most pertinent here are Rule IX, which deals with probationary employment, and <br />Rules XII, XIII and XIV, which pertain to discipline, separation from service, and appeals and <br />hearings, respectively. <br />A copy of Resolution No. R-15-00 is attached as Exhibit 1. <br />Ordinance No. 03-00 — An Ordinance of the Citv of Colton Revisina and Amendina the Civil <br />Service System for Said City <br />This Ordinance, adopted March 21, 2000, covers a variety of topics relating to the City's civil <br />service system, including the duties of the Human Resources Manager, the role of the Civil <br />Service Board, and the hearing and appeal rights of permanent, full-time competitive service <br />employees. <br />A copy of Ordinance No. 03-00 is attached as Exhibit 2. <br />Administrative Policy No. 4.04.030 — Harassment Policy Statement and Complaint Procedure <br />The City Council recently revised this Administrative Policy on August 15, 2006. Generally, <br />Administrative Policy No. 4.04.030 prohibits harassment of employees based on all legally <br />recognized protected classifications, including, gender, race, age, disability, etc. The Policy <br />defines hostile work environment and sexual harassment, and sets forth the City's responsibilities <br />
