GOMEZ, CITY CLERK <br />SUBJECT: BIENNIAL REVIEW OF THE CITY'S CONFLICT OF INTEREST <br />CODE <br />RECOMMENDED ACTION <br />It is recommended that the City Council: (1) direct staff to conduct a review of the City's <br />Conflict of Interest Code, and (2) direct the City Manager to file a statement regarding the <br />review with the City Clerk, as required by the California Political Reform Act of 1974 (Gov. <br />Code § 81000 et seq.). <br />GOAL STATEMENT <br />The proposed actions are pursuant to the requirements set forth in Government Code section <br />87306.5, which have been placed upon the City Council as the City's code -reviewing body. <br />BACKGROUND <br />The Political Reform Act (the "Act"), requires all public agencies, including cities, to adopt and <br />maintain a Conflict of Interest Code. The primary effect of the code is to establish disclosure <br />requirements for various City positions that are involved in government decision-making. In <br />compliance with the Act, the City of Colton adopted a local Conflict of Interest Code designating <br />City positions not otherwise designated in the Act itself that are involved in making, or <br />participate in the making of, government decisions at all levels of City government. The Act <br />further requires the City to regularly review and update its local Conflict of Interest Code as <br />necessary, when directed by the City Council as the code -reviewing body or when change is <br />necessitated by changed circumstances. (Gov. Code §§ 87306, 87306.5.) <br />ISSUES/ANALYSIS <br />The Act requires the City Council, as the code -reviewing body for the City, to direct the biennial <br />review of the City's Conflict of Interest Code on or before July 1 st of each even -numbered year. <br />(Gov. Code §§ 82011, subd. (c), 87306.5.) The Act also requires the City Manager to file a <br />statement ("Local Agency Biennial Notice") regarding the results of the review no later than <br />October 1St of the same year. (Gov. Code § 87306.5.) <br />
