CITYOF COLTON <br />For City CouncU Meeting of )/� <br />March ,E 997I 1 l 117 <br />March 13, 1997 <br />TO: MAYOR GAYTAN, CITY COUNCIL CITY MANAGER <br />FROM: Julie Hayward Biggs, City Atto e <br />SUBJECT: Possible Revision of Commissioner Appointment Ordinance <br />As you are aware, it was previously proposed that the Commissioner Appointment <br />ordinance be revised in accord with the provisions of Government Code Section 40605. That <br />code provision requires that the Mayor appoint, subject to approval by the City Council, all <br />members of all City boards and commissions. The statute also states that the only limitation <br />on this requirement is where other state law controls the appointment of such boards or <br />commissions. Our current provisions in this regard exempt only the Library Board from the <br />Commissioner Appointment ordinance. Legal review by the law firm of Rutan & Tucker <br />indicates, however, that the City may also exempt the Planning Commission from the provisions <br />of Government Code Section 40605. <br />Attached is a revised copy of the previously proposed amendment to our <br />Commissioner Appointment ordinance (Chapter 2.30 of the Colton Municipal Code) that <br />complies with the provisions of Government Code Section 40605 as interpreted by the law firm <br />of Rutan & Tucker. <br />If the Council wishes to amend the current City Code, it would be appropriate to <br />place this or another amended ordinance on the next City Council agenda for first reading. <br />Concurren <br />t t <br />Malik Dantala Freeman, City Manager <br />Item No. 30 <br />
