Garcia, C Manager t_ FROM: a amor o murnty Development Director SUBJECT: Approval of a Dance Permit for Zendejas Restaurant, located at 1030 South Mount Vernon Avenue, Colton DATE: July 26, 1999 BACKGROUND: Zendejas Restaurant is located at 1030 South Mount Vernon Avenue in the City of Colton. Mr. Jorge Hernandez, owner, is requesting a dance permit per Chapter 5.32 of the City's Municipal Code, Dances, Section 5.32.040, Permit — Application and Issuance. DISCUSSION/ANALYSIS: Mr. Jorge Hernandez is proposing to provide a variety of live entertainment and conduct public dances each week, as part of on-going social events at this location. The dances will cater to groups 25 years of age and above. The proposed hours of operation are daily, with live entertainment and dancing on Friday and Saturday from 9:00 p.m. until 1:00 a.m. The applicant currently has a Type 47 (on-site general) license, issued in August 1997, by the Alcoholic Beverage Control (ABC) subject to the following conditions: • Any graffiti painted or marked upon the premises or on any adjacent area under the control of the licensee(s) shall be removed or painted over within 48 hours of being applied. • The quarterly gross sales of alcoholic beverages shall not exceed the gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand. • The sale of alcoholic beverages for consumption off the premises is strictly prohibited. • The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control, as depicted on the ABC -257 dated 6-4-97 and ABC - 253 dated 6-4-97. • No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the ABC -257 dated 6-4-97 and ABC -253 dated 6-4-97. • Loitering is prohibited on or around those premises.
