R-48-99 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON REVOKING THE DANCE PERMIT FOR PROPERTY <br />LOCATED AT 195 WEST VALLEY BOULEVARD IN THE CrrY <br />OF COLTON (OLYMPIA BAR & GRILL, INC. DOING BUSINESS <br />AS THE "ROCKS CLUB") <br />WHEREAS, on April 6, 1999, the City Council of the City of Colton graded a dance <br />permit ("Dance Permit") to the Olympia Bar & Grill, Inc. (dba the "Rocks Club's ("Applicants") for <br />property located at 195 West Valley Boulevard, in accordance with the requirements of Colton <br />Municipal Codi Sections 5.32.030 and 5.32.040; and <br />WHEREAS, the Dance Permit was issued subject to certain conditions of approval in <br />accordance with Colton Municipal Code Section 5.32.050 providingthat"[T)hecity council may make <br />rules governing public dance halls or any public dance...;" and <br />WHEREAS, Colton Municipal Code Section 5.32.050 further authorizes the City <br />to revoke a Dance Permit at anytime after it is issued, "if they become satisfied that the <br />conduct of such public dance hall or public dance does not, or will not, comport with the public welfare <br />17 <br />for any mason, or in the case of a public dance hall that the same has been conducted in an illegal, <br />18 <br />improper or°disorderly manner," and <br />19 <br />20 WHEREAS, the City Council of the City of Colton held an administrative hearing on <br />21 June 1, 1999 to determine whether sufficient evidence existed to determine that the conduct of the <br />22 Rocks Chub does not, or will not comport with the public welfare for any reason, or that the Rocks <br />23 Club has been conducted in an illegal, improper or disorderly manner, and <br />24 <br />WHEREAS, evidence was heard and received from city staff during the administrative <br />25 <br />hearing concerning the conduct ofthe Rocks Club, including the occurrence of several po6oc incidents <br />26 and the failure tb abide by the conditions of approval; and <br />27 <br />28 WIIBREAS, the Applicant was present and represented by their attorney of record, <br />Mr. Roger Diamond, who was allowed to present evidence on the Applicant's behalf, cross-examine <br />ITEM #2 <br />
