Kivley, Assistant tot City Manager J`� <br />Subject: Amend Chapter 14, Municipal Code relating to to water isc ar es <br />Date: April 11, 2000 <br />[•33C(datilli p <br />On April 4, 1995, the City of Colton joined San Bernardino County and other cities in the Inland Empire to <br />jointly submit the National Pollutant Discharge Elimination System (NPDES) Permit Number CAS618036 to <br />the State Regional Water Quality Control Board, Santa Ana Region (Board). This submission renewed our <br />area wide NPDES permit for urban storm water run-off. This permit requires each city follow certain <br />procedures to reduce the amount of pollutants entering local waterways through the storm drain system. <br />On July 27, 1998, the California Regional Water Quality Control Board, Santa Ana Region issued <br />Administrative Civil Liability Complaint No. 98-93 (ACL) to the City of Colton (City). The suit alleged the <br />City violated certain aspects of the NPDES permit and assessed a $60,000 fine. The Executive Officer of <br />the Board proposed to suspend $50,000 of the assessment if the City submitted an approved <br />comprehensive compliance plan (Plan) and implemented the tasks mentioned in the Plan. Early in <br />November 1998, the City contracted with Inland Empire West Resource Conservation District (District) to <br />assist in developing the extensive Plan required by the Board. On November 10, 1998, the Board <br />established a deadline for submission of the Plan of January 4, 1999. On January 4, 1999, with <br />assistance from the District, the City submitted its completed Plan. <br />DISCUSSION/ANALYSIS <br />The ACL required the City address four areas. Those areas are: <br />1. Storm Water Conveyance System Inspections and Maintenance <br />2. Industrial/Commercial/Residential and Public Information <br />3. New Development/Redevelopment <br />4. Public Agency Activities <br />Contained under each area are numerous subsections addressing various areas of concern. Contained <br />within the report is a Gantt Chart. The following is a sample of the implement compliance tasks listed on <br />the chart: <br />• Hiring of a Maintenance Worker III solely dedicated to stormwater issues; <br />• Designation of a City NPDES Coordinator; <br />• Training of City-wide personnel in many department, including specialized training for <br />Fire personnel in NPDES issues; <br />• Partnering with the Fire Department's Business Inspection Program Teams to include <br />review for potential NPDES during their site inspections; and <br />• Development of number of programs addressing the monitoring of businesses, <br />development and City operations. <br />Item #1 <br />
