Item #3 CITY OF COLTON AGENDA REPORT FOR COUNCIL MEETING OF December 17, 2002 a PROVAL: Daryl Parrish, City Manager FROM: City Attorney SUBJECT: Sound Vehicle Ordinance DATE: December 11, 2002 BACKGROUND: In light of the proposed changes to the City's Special Events permit procedures contained in Chapter 5.44, the permit requirements for parades and sound vehicles that are contained in Chapter 10.16 must also be amended to resolve conflicting provisions. DISCUSSION/ANALYSIS: Currently, Chapter 10.16 (Sound Vehicles - Parades) requires a permit to conduct a parade, procession or caravan, or to operate any sound vehicle upon a public street. This Ordinance would: • Repeal those provisions requiring a permit for a parade, procession or caravan, since Chapter 5.44, as amended, will provide the permit procedures necessary for conducting such events. • Eliminate the requirement for a permit to operate a sound vehicle on public streets. This Ordinance, however, would provide regulations regarding the use of such vehicles on public streets, and any violations of such regulations would constitute a misdemeanor. Violators will also be subject to administrative penalties and fines. • Amend those provisions regarding prohibitions on the use of sound vehicles on public streets. Currently, Chapter 10.16 provides that sound vehicles may be used so long as they: (1) Do not come within 300 feet of any hospital or school at any time; (2) Are not used between the hours of 6:30 p.m. and 9:00 a.m.; (3) Are not used on any Sunday; or (4) Are not used upon 8`h 7,n 91h and 10`h Streets between "I" and "G" Streets, or upon "I" "G" and "H" Streets between 6th and 10`h Streets.
