Item #4 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR TTIE CITY COUNCIL MEETING OF JANUARY 21,2002 <br />TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS <br />FROM: AMER JAKHER, P.E., CITY ENGINEER ptt-- T -A - <br />SUBJECT: AUTHORIZATION REQUEST TO RELEASE OFF-SITE <br />AGREEMENT FOR PROPERTY LOCATED AT 2098 MARYLAND <br />AVENUE <br />DATE: JANUARY 9,2003 <br />BACKGROUND: <br />Residents who wish to secure a Building Permit from the City for the construction of a permanent <br />structure larger than four hundred square feet, are subject to certain conditions routinely imposed by <br />various City Departments during the Plan Check process. The Engineering Department (formerly <br />Public Works Department), has jurisdiction with regard to the requirements of curb, gutter, <br />sidewalk, drive approaches, etc., which are often referred to as "Off -Site Improvements". <br />On October 5, 1990, Jose N. Jasso and Virginia Jasso applied for a building permit to build a home <br />at 2098 Maryland, which is a comer lot also bordered by Mill Street. Upon review of said <br />application (plan check), conditions were imposed for the installation of "curb, gutter, sidewalk A C <br />paving and other related street improvement work along Mill Street & Maryland Avenue". The <br />property owners requested that the required improvements be deferred to a later date; accordingly, <br />an Off -Site Agreement between the property owners and the City was recorded on April 10, 1991, <br />as Document No. 91-119827, O.R. This "Agreemenf' is currently attached to the above -noted <br />property- <br />ANALYSIS/DISCUSSION: <br />In October of 2002, the construction of a Council approved Capital Improvement Project the 2001 - <br />2002 Pavement Rehabilitation Project which included improvements along Mill Street, was <br />completed. As a part of this CIP, the improvements along that portion of Maryland directly <br />adjacent to the property at 2098 Maryland were also completed. The property owners have <br />requested that the above -noted Off -Site Agreement attached to their property be released. <br />A copy of the original recorded document, "Agreement to Construct Off -Site Agreement", is <br />attached as Exhibit "A". The "Release of Agreement"to dissolve the previous Agreement between <br />the City of Colton and Jose M. Jasso & Virgina Jasso, as owners of the property located at 2098 <br />Maryland Avenue, is attached as Exhibit "B". <br />
