CITY OF COLTON <br />AGENDA REPORT <br />FOR THE COUNCIL MEETING OF OCTOBER 19, 2004 <br />Item #7 <br />TO: Honorable Mayor And Members of the City Council <br />FROM: Anthony Arroyo, Human Resources Manager <br />SUBJECT: Request Determination of Disability Status for Police Officer John <br />Hoffman <br />DATE: October 7, 2004 <br />BACKGROUND: <br />On July 24, 1989, John Hoffman was hired as a Police Officer for the Colton Police Department. <br />ANALYSIS/DISCUSSION: <br />On August 28, 2004, John Hoffman filed an industrial disability retirement application with <br />CalPERS. By law, the City Council is required to make a determination of the member's disability <br />and the deadline established is February 28, 2005 (six months after the City of Colton is in receipt <br />of the application). Given that Mr. Hoffman's effective retirement date is October 1, 2004, this item <br />is being presented to you before the end of the six months so that Mr. Hoffman can receive his <br />retirement benefits in a timely manner. <br />Even though the application is for industrial disability retirement, the City Council can proceed to <br />act on the issue of disability retirement by issuing a formal finding stating that Officer Hoffman was <br />disabled by an injury, as determined by a competent medical opinion, which rendered him <br />incapable of substantially performing the duties of a Police Officer, a position in the Colton Police <br />Department. <br />ENVIRONMENTAL IMPACT: <br />This item does not carry environmental impact. <br />FISCAL IMPACT: <br />There is no fiscal impact to the present budget since CalPERS will determine disability pension <br />payments. <br />CONFLICT OF INTEREST: — Gift Disclosure Requirements <br />None <br />RECOMMENDATION: <br />It is respectfully recommended that the Members of the City Council approve and adopt the <br />proposed Resolution, determining the disability retirement status of Police Officer Hoffman. <br />ATT: Resolution <br />City Attorney: <br />City Manager: <br />Agd Rpt Hoffman Dis Ret 101904 <br />Finance Director: <br />OTHER: <br />
