1 2 3 4 5 6 7 8 9 10 11. 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON APPROVING A ZONE CHANGE FROM C-2 (GENERAL COMMERCIAL) TO R-2 (DUPLEX RESIDENTIAL) FOR PROPERTY LOCATED AT 744 EAST "G" STREET IN THE CITY OF COLTON (DAP NO. 000-459) WHEREAS, Morgan Hills LLC, a California limited liability company filed an application (File No. DAP -000-459) requesting a zone change from C-2 (General Commercial) to R-2 (Duplex Residential) ("Application") for property located at 744 East "G" Street (Assessor Parcel No. 0162-202-31) in the City of Colton, County of San Bernardino ("Subject Site"); and WHEREAS, the Application was reviewed, studied, and found comply with the California Environmental Quality Act ("CEQK) as more fully described below; WHEREAS, on September 13, 2005, the Planning Commission of the City of Colton ("Planning Commission") conducted a duly noticed public hearing on the Application at which time all persons wishing to testify in connection with the Application were heard and the Application was fully studied; WHEREAS, the Planning Commission adopted a Resolution recommending approval of this Application to the City Council; WHEREAS, on October 18, 2005, the City Council of the City of Colton ("City Council") conducted a duly noticed public hearing on the Application at which time all persons wishing to testify in connection with the Application were heard and the Application was fully examined; and WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred; FOLLOWS: THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS SECTION 1. Based on the entire record before the City Council, all written and oral evidence presented to the City Council, and the findings set forth in this Ordinance, the City Council of the City of Colton hereby designates the Subject Site shown on the ORANGE\MXM\19705.1 -1-
