<br />Mr. Jim Cooper, Employee Representative of the San Bernardino Public Employees Association, spoke in behalf of Mr.
<br />Heimbecker advising the Council Members that the Civil Service Board had cast a unanimous vote to reinstate Mr.
<br />Heimbecker to his former position.
<br />Moved by Councilman Gonzales, seconded by Councilman Hayes, to accept the recommendation of the Civil Service Board
<br />and reinstate Mr. Howard Heimbecker to his position of Water Quality Control Plant Operator.
<br />Before the voting, City Attorney Edwards suggested it would be in order for the Council to require that disciplinary
<br />action be taken, if the Council so desires.
<br />Mr. Cooper spoke in opposition to the City Attorney's suggestion, reiterating the unanimous decision of the Civil
<br />Service Board on behalf of the employee.
<br />Councilman Gonzales stated that he would like to withdraw his motion. After additional discussion, Councilman
<br />Hayes stated that he would withdraw his second.
<br />Moved by Councilwoman Cisneros, seconded by Councilman Hayes, to reinstate Mr. Howard Heimbecker to his position of
<br />Water Quality Control Plant Operator effective November 13, 1976. Upon Roll Call, the Vote was:
<br />AYES: Two, Cisneros, Hayes
<br />NOES: Three, Beltran, Gonzales, Rehrer
<br />ABSENT: None
<br />Motion did not carry.
<br />Discussion followed among Council Members, Staff and Mr. Cooper.
<br />Moved by Councilman Rehrer, seconded by Councilman Gonzales, to refer this matter back to the Civil Service Board
<br />for additional review and recommendation. Upon Roll Call, the Vote was:
<br />AYES: Three, Beltran, Gonzales, Rehrer
<br />NOES: Two, Cisneros, Hayes
<br />ABSENT: None
<br />Motion carried.

<br />The City Council adjourned to Executive Session at 9:16 p. m., to discuss Personnel Matters, and reconvened at 9:41

<br />THE DISABILITY FOR RETIREMENT PURPOSES OF A LOCAL SAFETY MEMBER
<br />(SECTION 21023.63 CALIFORNIA GOVERNMENT CODE).

<br />-'Mayor Beltran announced that the Los Padrinos will host an "Open House" at the Pasa Tiempo Boutique, located at the
<br />corner of 7th and "H" Streets in Colton, and everyone is cordially invited, on Wednesday, December 22, 1976, from
<br />3:00 to 6:00 p. m.
<br />Mayor Beltran said on behalf of himself and all members of his family, he would like to wish everyone a very Merry
<br />Christmas and Happy New Year.

<br />A regular meeting of the City Council of the City of Colton was held on the above given date at 7:30 p. m., in the
<br />Council Chambers of City Hall, Mayor Beltran presiding.
<br />Mayor Beltran led the group in the Pledge of Allegiance to the Flag.
<br />Invocation was offered by the Reverend David R. Pasamonte of the United Methodist Church of Colton.
