further agrees to strictly enforce the same. COLTON and SAN <br />BERNARDINO agree to strictly comply with all requirements applicable <br />to their respective NPDES waste discharge permits issued for their <br />respective treatment plants upstream of the Demonstration System <br />and any agreements governing the quality of effluent discharged from <br />such plants. <br />16. Insurance. Each PARTY shall furnish and maintain <br />throughout the term of this Agreement comprehensive, general <br />liability insurance and automobile liability insurance coverage of <br />not less than $1,000,000.00 combined single limit. Each PARTY shall <br />cause the Demonstration System to be specifically included in their <br />respective policies. COLTON and SAN BERNARDINO agree to reimburse <br />SAWPA for any additional insurance costs incurred by SAWPA in <br />complying with these insurance requirements. <br />17. Indemnification. Except as otherwise provided herein, <br />each PARTY shall indemnify and hold harmless the others and their <br />agents, employees, representatives, successors and assigns, from and <br />against any and all loss, liability, costs, expenses, damages, <br />injury, and claims of any kind (whether in contract or tort, <br />including personal injury, death or property damage), including <br />attorneys' fees, legal expenses and expert witness fees and costs, <br />arising directly or indirectly out of, or in any way connected with, <br />the indemnifier's performance under this Agreement or any negligent <br />act or omission of the indemnifier or its employees, agents, or <br />representatives. <br />11 <br />
