Containers shall contain all signage, decals <br />and other information required hereunder and non-relating to other municipalities. Contractor shall <br />deliver initial or replacement Containers during regularly scheduled Collection hours. <br />Within seven days after receiving notice (based on Contractor's drivers' observations, information and <br />belief or otherwise) that a formerly unoccupied Residential or Commercial premise becomes <br />occupied, if Contractor does not receive a request for Services, it shall simultaneously give written <br />notice to the owner or occupant of such premises that weekly Collection Services are required by the <br />Environmental Health Code and simultaneously copy the City with such notice. City will ensure that <br />all health and safety codes are enforced within their jurisdiction. <br />On the next scheduled Collection day after receivin� Notice from City that City has discontinued, <br />terminated or cut off utility services (which include Collection of Solid Waste) for any Residential <br />account, Contractor shall pickup and remove such Customer's Automated Containers. <br />Contractor shall provide a secure location for inventory storage and shall distribute Containers from <br />inventory to new Customers and Customers who request replacements or additional container <br />exchan�es. Contractor shall maintain complete inventory, and Customer distribution records (by <br />volume and/or size) in accordance with Section 7.01 a. <br />(2) Change in Size or Number of Containers. <br />(i) On-Demand Customer Request (�thout Charge). Upon written or telephonic request of a <br />Customer, Customer may exchange Containers for different sizes, add extra Containers or reduce the <br />number of their Containers without charge, within basic Service parameters described in Exhibit <br />10.01. Contractor shall exchange, deliver and/or remove Container(s) in accordance with Customer's <br />request on such Customer's next regularly scheduled Collection day following receipt thereof. <br />(ii) Contractor Request: No Reduction. If Contractor believes that a Customer's request to reduce <br />its level of Service would result in repeated overflows of MSW in violation of the Environmental <br />Health Code, Contractor may notify the City Representative and handle such dispute in accordance <br />with the procedure attached as Exhibit 4.04d. <br />(iii) Contractor Request: Increased Servic� In the case of repeated overflows of MSW in <br />violation of the Environmental Health Code, Contractor shall contact the Customer, specify the <br />frequency of overflows and discuss increasing the size or the number of Containers at the premises or <br />increasing the frequency of pickups. Contractor shall implement agreed-upon changes within seven <br />days thereafter. However, if Contractor cannot successfully contact Customer after three attempts or <br />Customer does not agree to Service changes, Contractor shall Notify the City Representative, <br />15 <br />5/06/97 execution <br />
