City Attorney Biggs clarified that the proposed Resolution amends <br />R-34-93. <br />Councilmember Sandoval inquired if the proposal was consistent with <br />neighboring cities. Director Hutton stated that Staff had studied <br />this question and the answer is "Yes." <br />Hearing no response to the call for public comment, motion by <br />Councilmember Beltran, seconded by Councilmember Cisneros, to close <br />the public hearing. Unanimous vote. <br />Motion by Councilmember Bennett, seconded by Councilmember Cook, to <br />accept and adopt Resolution No. R-02-94. Unanimous vote. <br />RESOLUTION NO. R-02-94 - A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF COLTON SETTING WASTEWATER RATES <br />FOR SARI LINE USERS. <br />STAFF REPORTS <br />TREASURER'S REPORTS AND RECOMMENDATIONS: <br />Treasurer Williams declared that all of the community facilities <br />districts in the City issued bonds to finance improvements and from <br />time to time certain property owners have failed to pay their <br />required special taxes. To protect their bond holders, the City of <br />Colton has agreed to foreclose on the delinquent property owners. <br />As these proceedings are a specialized area of law, Treasurer <br />Williams requested that Council approve the Agreement to retain the <br />Law Office of Robert Owen. Treasurer Williams noted that there is <br />no financial impact for this action to the City as legal fees are <br />paid by the property owners when they cure the delinquency or <br />attorney fees are recovered when the property is sold. <br />Treasurer Williams recommended foreclosure actions for Community <br />Facilities Districts Nos. 87-1, 88-1, 89-1, 89-2 and approval of <br />special counsel agreement. <br />Motion by Councilmember Beltran, seconded by Councilmember Rios, to <br />order foreclosure actions as recommended by the Treasurer and to <br />approve Special Counsel Agreement. Unanimous vote. <br />RESOLUTION NO.
