unanimous and acknowledged that the City Manager has taken the City from <br />financial ruin to recovery and it is proper to give credit where credit <br />is due. <br />Motion and second by Councilmembers Sanders and Sandoval to call for the <br />question carried with Councilmember Bennett and Mayor Fulp voting "No." <br />Proposed motion to accept and approve Resolution R-104-95 carried with <br />Councilmember Bennett and Mayor Fulp voting "No." Councilmember Hutton <br />abstained from vote based on previous explanation. <br />RESOLUTION NO. R-104-95 - A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF COLTON ESTABLISHING TERMS AND <br />CONDITIONS OF EMPLOYMENT OF THE CITY <br />MANAGER. <br />STAFF REPORTS: <br />CITY CLERK'S REPORTS AND RECOMMENDATIONS: <br />Recall Petition (Sandoval) <br />City Clerk Ramos stated that the petition to recall Councilmember <br />Sandoval was determined to be sufficient and the proposed resolutions <br />were for the purpose of calling for election and to request services <br />from the County of San Bernardino, Registrar of Voters Office. Upon <br />questions for clarification, City Attorney Biggs stated that the matter <br />was on the previous City Council Agenda and a motion to approve the <br />resolutions died for lack of a second. City Clerk Ramos advised that <br />City Council needed to act on this matter as legal language found in the <br />code stated "shall" and if City Council fails to act, the Board of <br />Supervisors of the County of San Bernardino must intervene. <br />Councilmember Sandoval assured fellow Members that he did not mind their <br />action as it must act. <br />Motion by Mayor Fulp, seconded by Councilmember Bennett, to accept and <br />approve Resolutions Nos. R-105-95 and R-106-95 carried with <br />Councilmember Hutton voting "No." <br />RESOLUTION NO. R-105-95 - A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF COLTON, CALIFORNIA, CALLING AND <br />GIVING NOTICE OF THE HOLDING OF A SPECIAL <br />MUNICIPAL ELECTION ON TUESDAY, FEBRUARY <br />60, 19964, FOR THE SUBMISSION OF THE <br />QUESTION OF THE RECALL OF A CERTAIN <br />OFFICER AND THE ELECTION OF CANDIDATES TO <br />FILL THE VACANCY IF THE RECALL PREVAILS. <br />RESOLUTION NO.
