r <br />(9A) Personnel/Finance <br />Ratification of Employee Appointment to the Full -Time <br />Position of Senior Accountant in Finance Department. <br />Motion by Councilmember Sandoval, seconded by Councilmember <br />Beltran, to approve the Consent Calendar, except for Items Nos. 3, <br />41 51 6 and 9, carried upon unanimous vote. <br />Item 3 - Contract <br />Mayor Fulp asked if the award of Contract was to Lake Cadena Sewer <br />Force Main, in the amount of $110,000, to replace an old line that <br />was plastic and now had eruptions. Public Utilities Director Les <br />Evans said it was as mandated by Regional Water Quality Control <br />Board. Mayor Fulp inquired if the lowest bidder Wyatt Construction <br />was owned by Randy Wyatt, who is also a member of the Utilities <br />Commission. Director Evans said that he was. Mayor Fulp inquired <br />if performance criteria was checked and Director Evans said he had <br />checked Mr. Wyatt's references and they checked out well; however, <br />none of the work was for underground pipeline work. After Director <br />Evans questioned him on that, Mr. Wyatt agreed he had no expertise <br />in that area and stated he hired Mr. Coy Hayes who did have the <br />necessary expertise. Director Evans and Public Utilities Manager <br />Billy Roth met with Mr. Hayes and they agreed Mr. Hayes was <br />experienced in pipeline work. In formulating the bid, Wyatt <br />Construction had arrangements with journeyman contractors who <br />actually prepared the bids and performed the work. <br />Director Evans confirmed that this item was approved in the <br />water/wastewater capital improvement budget at $150,000. Director <br />Evans said the item did not go to the Utilities Commission for <br />their review. He stated that Mr. Wyatt's business was a local <br />business and the only one on the list. Mr. Evans said he did not <br />anticipate any change orders as this was a relatively small job. <br />He said the bid was by unit price which was estimated at 2,070 <br />lineal feet and this was a straight -forward job. He indicated that <br />the only variable is the units. Director Evans said the contractor <br />estimated the time -frame at 100 feet a day, for a total of 21 work <br />days, with the project to commence on January 2, 1996. <br />There was brief discussion about Mr. Wyatt's service on the <br />Utilities Commission. Director Evans said he had contacted the <br />City Attorney. City Attorney Biggs stated there was no conflict of <br />interest unless Mr. Wyatt participated in the decision-making <br />process in his official capacity and since the matter did not go <br />before the Utilities Commission, there was no conflict. <br />Motion by Councilmember Sandoval, seconded by Councilmember Hutton, <br />to award the Lake Cadena Sewer Force Main Replacement Project to <br />Wyatt Construction in the amount of $111,740.50.
