Motion carried, with Mayor Fulp and <br />Councilmember Sanders, voting NO. <br />Item 16 Litigation <br />Ratification of Participation in Amicus Curiae brief in the <br />case of Santa Clara County Local Transportation Authority v. <br />Guarding (Reconsideration of Prospective Effect of Ruling on <br />Proposition 62.) <br />Motion by Councilmember Bennett, and seconded by Mayor Fulp, not <br />to participate in the amicus brief. <br />Councilmember Bennett stated her reasons for not participating: <br />SCAG has recommended that Cities not participate; and she urged <br />Council not go against the wishes of the taxpayers of the State <br />of California. Julie Biggs, City Attorney responded. <br />Motion failed, with Mayor Fulp and Councilmember Bennett, voting <br />YES. <br />Motion by Councilmember Sandoval, seconded by Councilmember <br />Beltran, to approve staff's recommendation to participate in the <br />amicus brief. Motion carried, with Mayor Fulp and Councilmember <br />Bennett, voting NO. <br />PUBLIC COMMENT <br />Jean Hart, Colton resident, asked about the following: Where did <br />the money come from to build houses below Scenic Dr? Where did <br />the money come from for the City Manager's raise? She referred to <br />Councilmember Beltran's statement to make the City of Colton a <br />"showplace"; Clean up of the alley off of Fairview; and the use <br />of RDA funds to resurface the streets. Councilmember Beltran, <br />Anna Vega, Finance Director, David Zamora, Community Development <br />Director responded. <br />Joe Nichy, President of the Colton Youth Football League, was <br />presented a check for $1,250.00 by Mayor Fulp who has been <br />working on raising funds for the League. Mr. Nichy expressed his <br />thanks and informed the Council of the recent accomplishments of <br />the League. <br />William Richards, Colton resident, thanked the Code Enforcement <br />Department for responding to the complaints he submitted. He <br />suggested creation of a City Beautification Program which would <br />be responsible for identifying areas where there are weeds, over- <br />grown grass and other debris.
