City Manager Martinez said he <br />would look into the matter. <br />AGENDA REVIEW <br />Mayor Fulp directed that item 6, regarding qualification for CDBG funding, be continued to the <br />Agenda of April 2nd. <br />MAYOR AND COUNCIL ITEMS: <br />Board & Commission <br />For District 6, Councilmember Hansen reported that the appointees to the Civil Service Board <br />and the Historic Commission would continue to serve and that Planning Commissioner <br />DeLaTorre had resigned. <br />Utilijy Users Tax <br />Councilmember Hansen indicated that even though Prop 62 was challenged, the Utility Users <br />Tax was legal; however, based on the assurance that the Users Tax was a supplement for the <br />General Fund, he asked Council to rescind its prior action. <br />Motion by Councilmember Hansen, seconded by Councilmember Bennett, to accept and adopt <br />Ordinance No. 0-06-96, Repealing Chapter 3.40 of the Colton Municipal Code Relating to the <br />Establishment of a Utility Users Tax. <br />Councilmember Sanders recalled that two weeks ago, staff was directed to conduct a study and <br />said it was a misnomer to identify the UT tax as a supplement to the general fund. City <br />Manager Martinez and Finance Director Vega reviewed the salient points of the Utility Users <br />Tax, namely, Time Limit, Audit, Budget, Funding, Contingency Reserves, General Plan Update, <br />Special Elections, Cease/Desist Order Lifted, Credit Restored, Disaster Preparedness, Furloughs <br />and Staff and Debt Payment. <br />Ms. EWne Craig, SBPEA Representative, did not support repeal of the Utility Users Tax as it <br />would have great impact on the City's employees and their families. She noted that the Utility <br />Users Tax will end in 1988, and she concluded the tax was needed. <br />Mr. Charles Jackson advocated repealing the Utility Tax as monies were not applied to debt <br />reduction. He inquired if Utility Tax paid $750,000 in overtime, which he termed unfair. He <br />said management should oversee the overtime pay. He was critical of management. <br />Above motion failed with Councilmembers Hansen and Bennett and Mayor Fulp voting "Yes." <br />Community Facilities Districts Exemption <br />2 <br />MAR 2 0 1996 <br />
