At Lame Mayor Gaytan commended CM Bennett for her stance on a possible conflict of <br />interest on Agenda Item 15. <br />AGENDA REVIEW: <br />Items Nos. 4, 8 12, 13 and 14 were pulled for separate action. <br />ITEM 4 - MINUTES: CM Bennett asked that the Minutes of August 4, be corrected by striking <br />the notation that she arrived at 9:18 P. M. She stated that she was present for the entire meeting <br />which was borne by the voting record. <br />ITEM 12 - PUBLIC WORKS: CM/Director Hutton stated this was a technicality as the Planning <br />Department had previously denied a certain prior request regarding a street vacation by Union <br />Pacific Railroad. Staff recommended that September 1' 1998, be set as the public hearing date <br />for Council's consideration. He respondedto the question of time lapse from November of 1997, <br />after the appeal approval, to the present. The question was then directed to City Manager Garcia <br />for investigation and report. CM/Director, Hutton asked the City Clerk to provide a copy of the <br />Minutes dated 11/4/97, for the September 18` agenda. <br />MOTION/VOTE: Motion/second by CM' Bennett/Grimsby to approve Resolution No. R-82-98, <br />to set a public hearing on September 1, 1998. Discussion ensued regarding adverse impact of <br />idling and stacking of locomotives. Union Pacific Railroad Representative Gonzales responded. <br />CM Bennett left her place on the dais. <br />Primary motion carried with CM Bennett and CM Chastain absent <br />ITEM 13 - TOWING FRANCHISE: City Attorney Carvalho advised that separate vote was <br />required as this was the first reading of an ordinance. <br />MOTION/VOTE: Motion/second made by CM Cook/Mayor Gaytan to waive full reading and <br />Pass First Reading of Ordinance No. 0-18-98, adding Chapter 10.40 to Title 10 of the <br />Colton Municipal Code concerning tow truck franchises for City service, carried with CM <br />Bennett and CM Chastain absent. <br />Motion/second by CM Cook/Hutton to approve and adopt Resolution No. R-83-98, establishing <br />criteria for granting tow truck franchises, carried with CM Bennett and CM Chastain absent. <br />After brief inquiry, motion/second by Mayor Gaytan/CM Cook to approve and adopt Resolution <br />No. R-84-98, approving tow truck franchise agreements (Pepe's Towing Service, Inc. and <br />Patriot Towing, dba Whitehouse. Enterprises, Inc.), carried with CM Bennett and CM <br />Chastain absent. <br />ITEM 14 - LEVY TAXES: <br />MOTION/VOTE: Motion/second by CM Cook/Mayor Gaytan to approve and adopt Resolution <br />No. R-85-98, assessing properties within the City boundaries in the amount of $117,600 for the <br />Council Mins August 18, 1998 6 <br />
