MOTION: Motion/second by CM Sanders/Grimsby to waive full reading and pass first reading <br />of an Ordinance of the City of Colton deleting Chapters 1. 12, 6.08, 6.12, 6.20, 6.22, 6.36, 7.04, <br />7.09, 9.26, 10.24, 12.04, and 18.56, deleting Section 6.28.150(B), adding Section 15.040.90(C), <br />and amending Title 8 of the Colton Municipal Code relating to property maintenance, seasonal <br />abatement of weeds, abandoned vehicles and enforcement procedures, ORDINANCE NO. 0-07- <br />00. <br />City Attorney Carvalho read the following findings into the record and she stated that they would <br />be part of the proposed ordinance: <br />"Whereas, Title 25, section 52 of the California Code of <br />Regulations empowers the City of Colton to use its own abatement <br />procedures so long as these procedures are equivalent to the procedures <br />contained in Title 25 sections 48 through 70 of the California Code of <br />Regulations, and provided such procedures provide an efficient and <br />effective procedure for the abatement of substandard conditions with <br />fairness to both owners and residents; and <br />"Whereas, Chapter 8.04 of the Colton Municipal Code provides <br />efficient and effective procedures for the abatement of substandard <br />buildings, structures and nuisances that are fair and equitable to both <br />owners and residents." <br />If there is a lack of quorum, Attorney Jeff Bellinger and City Attorney Carvalho advised that the <br />proposed ordinance authorized the City Manager to appoint a separate hearing body so that the <br />property owners would receive due process as required by law. There was discussion on the need <br />to set a regular meeting time for the Code Enforcement Commissioners to meet. <br />MOTION/VOTE: CM Sanders, maker of the primary motion, amended the main motion to <br />include the direction given to Staff to set a regular meeting time for the Code Enforcement <br />Commission. CM Grimsby, the second to the main motion, accepted the amendment. The <br />motion carried upon unanimous vote. <br />PUBLIC HEARING: <br />Ll RUVUR <br />This was the time and place fixed to consider ordering the levy and collection of assessments <br />within the Landscape and Lighting Maintenance District No. 1 (LLMD. No. 1). <br />Mayor Pro Tempore Bennett declared the Public Hearing "Open," <br />City Clerk Barrera stated the Affidavit of Publication was on file in the City Clerk's Office and <br />reported she did not receive any protests or objections. <br />Parks, Recreation and Family Services Director Ron Kenny said that neither new nor increased <br />assessment rates, nor annexes, were proposed for the year 2000-01.
