Unanimous vote. <br />CITY MANAGER'S REPORTS AND RECOMMENDATIONS: <br />Cooperative Agreement, City of Riverside <br />Assistant to City Manager Daryl Parrish provided summary of the cooperative agreement with the <br />City of Riverside for design and construction of street improvements, previously approved by the <br />Colton City Council. <br />MOTION: Motion by CM Cook, seconded by CM Chastain, to approve Staff's recommendation <br />for approval of the Cooperative Agreement, with the City of Riverside, for the design and <br />construction of street improvements for the Center Street Extension Project, said agreement to <br />include the changes to the language suggested by Best, Best & Krieger, Attorneys for the City of <br />Colton. <br />ACM Parrish responded to inquiry on the following: (1) Under Discussion and Analysis, the <br />savings to be realized equals $180,000 for a right-of-way acquisition. (2) Under fiscal impact, the <br />sum of $300,000 includes the costs for environmental reports and surveys. Each City to pay 50% of <br />such costs. (3) The Cooperative Agreement does not have a cap. (4) ACM Parrish and Director <br />Clarks plan to discuss the use of allocated funds from the water and/or sewer capital improvements <br />funds as there is great potential for that to occur since there are master plans improvements in the <br />area: Water and sewer lines, flood stations and wells. ACM Parrish assured that CIP funds, not <br />general fund monies, were expected to be used. <br />G.F. Brewton, representing land developer, G. W. Singletary, and the property owners, spoke in <br />support of the item. <br />VOTE: On the main motion, the vote was unanimous. <br />CITY ATTORNEY'S REPORTS AND RECOMMENDATIONS: <br />CLOSED SESSION: <br />City Attorney Carvalho announced that City Council would meet in Closed Session to discuss the <br />following items. She informed that, regarding Item (B), only two items would be discussed. <br />(A) CONFERENCE WITH REAL PROPERTY NEGOTIATOR <br />Pursuant to Government Code Section 54956.8 <br />Property: Portland Cement/Agua Mansa <br />Negotiating Parties: Portland Cement and Big League Dreams <br />Negotiation: Terms and Conditions <br />(B) CONFERENCE WITH LEGAL COUNSEL — ANTICIPATED LITIGATION <br />Significant Exposure to Litigation pursuant to Government Code Section 54956.9(b). <br />Number of Potential Cases: 3 <br />City Council Mins May 2, 2000 6 <br />
