Motion/second by CM DeLaRosa/Grimsby to approve and adopt RESOLUTION NO. R-74-00, <br />r, known as the resolution of intention to approve an amendment to contract between the Board of <br />Administration, California Public Employees Retirement System and the City Council of the City <br />of Colton. Motion carried with CM Sanders voting "No." <br />MAYOR AND COUNCIL ITEMS: Comments, Inter -Governmental Agency reports, <br />Information Session and Action Items: (Continued) <br />Competitive Bond Sale <br />City Treasurer reported on the $5.7 million wastewater financing accomplished by a low-cost <br />competitive bond sale: Fourteen firms made bids and the winning bidder made the lowest interest <br />cost, slightly above 5 % on 20 -year financing. <br />AGENDA REVIEW: <br />Assistant City Manager Parrish provided clarification to Item 6, substituting under <br />recommendation for "childcare services" should state "for State Latch Key Services." On Item <br />11 regarding the award of the contract for pavement rehabilitation, Staff recommended the low <br />bid. Item No. 9 was removed from the agenda. <br />Item 3 - After discussion, copy of the staff report approving the selection of HdL was requested. <br />Item 11 - Discussion followed on the application of "local use" rule. ACM Parrish stated the <br />preference rule did not apply to public works contracts. <br />City Attorney Carvalho advised this was a public works contract governed by State law that <br />mandated the award of bid to the lowest bidder, unless it could be found that the low bidder was <br />incompetent. After discussion, City Attorney Carvalho advised that if the City violated the State <br />law, the City could have some liability with respect to the first bidder's losses. <br />After discussion, City Council strongly suggested that for future staff reports, whether street <br />pavement or storm drain, that Staff be directed to include some kind of chronology of change <br />order activity. <br />Further, City Attorney Carvalho advised that State law required Council to, initially, authorize <br />staff to take the matter to bid and she suggested that this was Council's opportunity to identify the <br />criteria and ask staff about specifications and requirements established for the bid or project. <br />Discussion followed on change orders. Public Works Director John Hutton informed that, by <br />State law, there was a certain percentage allowed for change orders in public works contracts. He <br />said that all change orders, along with the original contract amount, on public works contracts <br />have to be presented to the City Council. City Attorney Carvalho said she would prepare <br />information for staff on this subject. The following subjects were discussed: Staff <br />recommendation and legal review.
