Wade Goding, applicant requested in view of the staff's recommendation before council, a <br />continuance until June 4, 2002 so that they could prepare to defend the issue that is now at <br />hand versus the appeal on the variance. <br />City Attorney Derleth clarified for Council what is before them to decide and to take action and <br />that the request of the applicant relates to two issues, one is threshold issue whether drive thru <br />restaurant is allowed in an I.P. Zone; Council determines if a drive thru restaurant is allowed in <br />IP Zone with a CUP; and the next issue, should the variance be granted for parking. Applicants <br />were only prepared to talk about the variance issue but not prepared to argue if it is authorized <br />in an IP Zone with CUP. <br />Motion/second by CM De La Rosa/Chastain to Continue the Public Hearing to Tuesday, June 4, <br />2002. Unanimous vote. <br />Mayor Bennett with no opposition from the Council moved Agenda Item 26 forward. <br />STAFF REPORTS <br />UTILITY DEPARTMENT REPORTS & RECOMMENDATIONS: <br />Authorize the Electric Utility to Enter Into an Engineering/Procurement/Construction Contract <br />with Noresco to Build a Generating Facility with a Nominal -Ca-pacity Rating Not To Exceed 49 <br />Electric Utility Director Clarke summarized the agenda report and recommended approval of <br />staff's recommendation.
